1-4-1: GENERAL PENALTY 1 :
   A.   Whenever in this Code or any ordinance of the Village any act is prohibited or is made or declared to be unlawful or a misdemeanor, or whenever in this Code or Village ordinance the doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision shall be punished by a fine of not more than seven hundred fifty dollars ($750.00). Each day any violation of any provisions of this Code or Village ordinance shall continue shall constitute a separate offense. In addition to the monetary penalty, the Village shall have the right to issue notices/orders directing an entity to restrain, correct, and remove any work done in violation of the Village's Building and/or Zoning Code. Nothing herein shall prevent the Village from filing a lawsuit, at law or in equity, to ensure compliance with all applicable Village Code provisions. (Ord. 1218, 2-12-2003)
   B.   A penalty imposed for violation of this Code or a Village ordinance may include, or consist of, a requirement that the defendant perform some reasonable public service work such as, but not limited to, the picking up of litter in public places or along public highways or the maintenance of public facilities. 1-4-2: APPLICATION OF PROVISIONS:
   A.   Application Of Penalty: The penalty provided in this chapter shall be applicable to every section of this Code the same as though it were a part of each and every separate section. (1999 Code)
   B.   Acts Punishable Under Different Sections: In all cases where the same offense is made punishable or is created by different clauses or sections of this Code or within Village ordinances, the prosecuting officer may elect under which to proceed, but not more than one (1) recovery shall be had against the same person for the same offense; provided, that the revocation of a license or permit shall not be considered a recovery or penalty so as to bar any other penalty being enforced.    C.   Breach Of Provisions: Whenever the doing of any act or the omission to do any act constitutes a breach of any section or provision of this Code and there shall be no fine or penalty specifically declared for such breach, the provisions of this chapter shall apply. (1999 Code)
1-4-3: LIABILITY OF OFFICERS:
No provision of this Code designating the duties of any officer or employee shall be so construed as to make such officer or employee liable for any fine or penalty provided for a failure to perform such duty, unless the intention of the Village Board of Trustees to impose such fine or penalty on such officer or employee is specifically and clearly expressed in the section creating the duty. 1-4-4: VIOLATION CITATIONS:
   A.   Police Officer Issuing Citation:
      1.   Whenever a police officer is authorized to arrest a person without a warrant because of a violation of this Code or a Village ordinance in respect of any of the following subjects:
         a.   Regulating and licensing dogs;
         b.   Regulating and licensing businesses;
         c.   Regulating and licensing vending machines and mechanical amusement devices;
         d.   Regulating the storing and disposal of garbage and rubbish;
         e.   Littering;
         f.   Regulating the burning of garbage and rubbish;
         g.   Regulating weed control;
said police officer may, in lieu of the filing of a complaint in court, in the first instance, issue to such alleged violator a citation.
      2.   The citation shall:
         a.   Advise said person that he has violated a specified Village Code section or Village ordinance;
         b.   Request him to make payment in an amount applicable to said alleged violation; and
         c.   Inform him that upon failure to comply, a complaint may be filed in the Circuit Court of Will County, charging him with such violation. (Ord. 1760, 8-24-2016)
