8-3-1: DEFINITIONS:
For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
BOULEVARD: Those strips of land next to public roadways lying between the curb and the platted line of the adjoining real property used for the planting and growth of trees and grass. Synonymous with "parking" as defined herein.
PARK: All those tracts of land used or in possession of the city, set apart or dedicated as places of public recreation.
PARKING: Those strips of land next to public roadways lying between the curb and the platted line of the adjoining real property used for the planting and growth of trees and grass. Synonymous with "boulevard" as defined herein.
PARKWAY: Those tracts of land situated on public roadways, not open to public travel but set apart for the planting and growth of grass, flowers, shrubbery and trees and the beautifying of the roadway, but not including parkings or boulevards. (Ord. 2541, 5-16-2016)
8-3-2: PUBLIC PARKS ESTABLISHED:
The following listed parks heretofore established, are designed and established as public parks at respective places according to the plats of certain additions to the city, as such plats now appear of record in the office of the register of deeds of the county:
Amphitheater Area: All that property in the north half of the southeast quarter of section 9, township 103 north, range 60, west of the 5th P.M., lying between Indian Village Road and Lake Mitchell.
Boat Ramp Area, East: That property which the northwest quarter of the northeast quarter of section 9, township 103 north, range 60, west of the 5th P.M, lying between Indian Village Road and Lake Mitchell, and not within the fenced boundary of the prehistoric Indian village.
Boat Ramp Area, West: All that property within the southwest quarter of the northeast quarter of section 5, lying between Lake Mitchell and West Harmon Drive, and irregular tract no. 1 in the northwest quarter of section 5, all in township 103 north, range 60, west of the 5th P.M., Davison County, South Dakota.
Cadwell Sports Complex: Outlot B-1, north six hundred ninety feet (690') of outlot A-1, Shelvin's First Addition, and the southwest quarter of section 16, all in township 103 north, range 60, west of the 5th P.M.
Dakota Wesleyan University Campus: East three hundred feet (300') lying between Hurst Street on the north and Norway Street on the south, bordered on the east by vacated University Avenue, less the Morrow Gymnasium Parking Lot. (Joint use park area leased from Dakota Wesleyan University for 25 years. Lease commencing January 1, 1981, and ending December 31, 2006.)
Doty Park: Block 17, F.M. Greene's Addition to the city of Mitchell, Davison County, South Dakota.
Dry Run Creek Parkland: Lot B of outlot 28, lot B of outlot 27 and the unplatted portion of Railroad Addition lying north of lots 80, 81 and 43 of Overlook Addition, outlot 26, outlot 25, outlot 24 (including lot 1, sublot 1, sublot 2, sublot A and irregular tract 1, all within said outlot 24), block 23, lots 1, 2 and 3 of block 16, block 15, lots 1, 2, 3, 4, 5, 9, 10, 11 and 12 of block 14, block 1, block 2, block 3 (except lots 3, 4, 5, 6 and 7 thereof), block 4 (except lot 8 thereof and except the south one hundred feet (100') of lots A, B and C thereof), all of the entire foregoing being within Railroad addition of the city of Mitchell, Davison County, South Dakota.
Firesteel Park Area: Being that part of government lot 3 in the northeast quarter of the northwest quarter of section 5, township 103 north, range 60, west of the 5th P.M., in Davison County, South Dakota, lying west of South Harmon Drive, and that part of government lot 4 in the northwest quarter of the northwest quarter of section 5, township 103 north, range 60, west of the 5th P.M. in Davison County, South Dakota, lying east of South Harmon Drive, and that part of the southwest quarter of section 32, township 104 north, range 60, west of the 5th P.M. lying south of South Harmon drive, all of which is commonly referred to as the fifty five acre tree farm.
Gainer Park: Block 93, Lawler second addition to the city of Mitchell, Davison County, South Dakota.
Hitchcock Park: The northeast quarter of the southeast quarter of section 22, township 103 north, range 60, west of the 5th P.M., Davison County, South Dakota, except that portion thereof contained within Driving Park addition to the city of Mitchell, and except the Chicago, Milwaukee and St. Paul railroad right of way.
Indianhead Park: Indianhead 3rd addition as indicated in plot book 11, page 70.
Jennewein Park: Park no. 5 according the recorded plat of University addition to the city of Mitchell, Davison County, South Dakota.
Kibbee Park: Lots K, W and C of Bayside subdivision to Lake Mitchell, according to the replat thereof dated March 27, 1975, and lot K-1, and all that part of the northwest quarter of the northwest quarter of the northwest quarter of section 10, township 103 north, range 60, west of the 5th P.M., lying west highway 37, Davison County, South Dakota.
Kiwanis Woodlot Area: All that property in the southeast quarter of the southeast quarter of section 9, township 103 north, range 60, west of the 5th P.M., lying between West 26th Street and Lake Mitchell.
Lake Mitchell Campground Area: The northeast quarter of the southeast quarter of section 9, adjacent to Lake Mitchell, and that property in the northeast quarter of the southeast quarter of the southeast quarter of section 9, all in township 103 north, range 60, west of the 5th P.M., adjacent to Lake Mitchell, and that portion of Lot 10A in the southwest quarter of section 10, township 103 north, range 60, west of the 5th P.M., lying south of Lake Mitchell, Davison County, South Dakota.
Lakeview Municipal Golf Course: The northeast quarter of the southwest quarter of section 9, and the southeast quarter of the northwest quarter of section 9, and the northeast quarter of the northwest quarter of section 9, and the southeast quarter of the northwest quarter of the northwest quarter of section 9, south of Indian Village Road and excluding therefrom any part thereof which lies within two hundred feet (200') of Indian Village Road, all in township 103 north, range sixty, west of the 5th P.M., Davison County, South Dakota.
Mitchell Activity Center (Ice Arena): East four hundred thirty nine feet (439') of north one thousand feet (1,000') exc north six hundred ninety feet (690') of outlot A-1, southwest quarter of section 16, township 103 north, range 60, west of the 5th P.M.
Mitchell Recreation Center: Lots E-2 and A-2 Hoven and Rogers addition to the city.
Municipal Bathing Beach: Lots 25 through 31, Bayside subdivision to Lake Mitchell, Davison County, South Dakota.
Munroe Park: Block 32, Capital addition to the city of Mitchell, Davison County, South Dakota.
Northridge Park: Lot E in the southwest quarter of section 15, township 103 north, range 60 west of the 5th P.M., lot 18, block 1, Northridge addition to the city of Mitchell, lot V and lot X-1 and that portion of lot D lying north of 11th Street, all in the south half of the southeast quarter of section 15, township 103 north, range 60, west of the 5th P.M. Davison County, South Dakota.
Patton Young Park: Outlot 1 in the southwest quarter of section 21, township 103 north, range 60, west of the 5th P.M., Davison County, South Dakota.
Pioneer Park: Lot 8, according to the original plat of University addition to the city of Mitchell, Davison County, South Dakota.
Redstone Area: hat area in the northwest quarter of the southeast quarter of section 4, township 103 north, range 60, west of the 5th P.M., and lying between lot 48 of Bayside subdivision and lot 1 of Sunset Point subdivision, and lying west of North Harmon Drive, Davison County, South Dakota.
Sandy Beach Area: Irregular tract no. 1 in the south half of section 32, township 104 north, range 60, west of the 5th P.M., Davison County, South Dakota.
University Addition: Lots 12, 13 and 14, block 34 to the city of Mitchell, Davison County, South Dakota.
West Point Area: That portion of government lot 4 in the northwest quarter of the northwest quarter of section 5, township 103 north, range 60, west of the 5th P.M., lying between West Harmon Drive and Lake Mitchell, and that portion of the southwest quarter of section 32, township 104 north, range 60, west of the 5th P.M., lying between West Harmon Drive and Lake Mitchell. 8-3-3: PARKWAYS ESTABLISHED:
The following listed parkways, heretofore established, are designated and established as parkways at respective places according to the plats of certain additions to the city, as such plats now appear of record in the office of the register of deeds of the county:
Court Merrill Parkway: Being in the center of that portion of Court Merrill abutting on lots A, B and C of block 3, and lots 3, 4, 5 and 6 of block 4 and lots 7, 8 and 9 of block 12, all in University addition, the width of the roadway on each side of such parkway being established at twenty feet (20') and the width of such parkway being established at eighty feet (80') at the point where Mylan Avenue intersects said Court Merrill.
Mylan Avenue Parkway: Being in the center of Mylan Avenue from Court Merrill to South Sanborn Boulevard, the width of the roadway on either side of such parkway being established at twenty feet (20').
Parkway No. 1: Being designated on the plat of University addition as "Park No. 1".
Parkway No. 2: Being designated on the plat of University addition as "Park No. 2".
Parkway No. 3: Being designated on the plat of University addition as "Park No. 3".
Parkway No. 4: Being designated on the plat of University addition as "Park No. 4".
Parkway No. 9: Being designated on the plat of University addition as "Park No. 9". (1984 Code § 26-3)
