A. Athletic Events:
1. Restricted To Designated Areas: No person shall play at any game of baseball, tennis, football, croquet or other game likely to cause damage to lawn or surroundings in any park unless such game is played on portions of such park especially provided and designated for such purpose. (1984 Code § 26-13)
2. Scheduling Of Athletic Events: No softball, baseball or other athletic tournament shall be held upon park property unless the same shall first be scheduled through the Park and Recreation Office. No such tournament shall be conducted in such manner as to constitute a violation of any provision of this Code or other City or State law. (1984 Code § 26-4)
B. Concessions:
1. Liquor: A permit or license is required by the Governing Body of the City for any organization or association to sell any alcoholic beverage in any park.
2. Concessions: No person shall sell or offer for sale any article or operate any concession without first securing a written permit from the Park and Recreation Board, which shall have the power to fix and collect fees for such permits. (1984 Code §§ 26-5, 26-23)
C. Traffic Regulations:
1. Traffic Laws Apply: All provisions of this Code or other ordinances governing travel or traffic upon public streets shall be applicable within all parks. (1984 Code § 26-6)
2. Vehicles And Horses To Remain On Roadways: No person may operate any motor vehicle or ride any horse in any park or upon any City property, except upon drives and roadways specified for such purposes. A bicycle as defined in section 7-8-1 of this Code is not considered a motor vehicle for the purposes of this subsection. (Ord. O2019-03, 4-15-2019, eff. 7-1-2019)
3. Certain Vehicles Restricted: The Park and Recreation Board shall have power, whenever it may deem it necessary for safety of the public, to exclude certain classes of vehicles from any park or from any portion thereof or to provide that traffic shall move only in one direction. In such cases, the board shall cause notices to be posted in conspicuous places in such park or roadways thereof, which notices shall specify such regulation of the board concerning such traffic. (1984 Code § 26-6)
D. Closing Hours: No person shall be or remain in nor leave any vehicle in any park or parkway, including the public beach, between the hours of eleven o'clock (11:00) P.M. and daylight the following morning.
E. Additional Rules And Regulations: The Park and Recreation Board may further regulate the use of the public parks and parkways and the public beaches; and such other regulations, when posted in a conspicuous place upon the property, shall be deemed enforceable pursuant to this chapter. Any violation thereof shall constitute violation pursuant to this chapter. (Ord. 1703, 9-16-1991)
A. Depositing Litter In Parks: No person shall deposit or leave any litter, bottles, rubbish or garbage in any park, except in containers provided for such purposes. (1984 Code § 26-7)
B. Glass Beverage Containers: No person shall have under his possession or control any glass beverage container or bottle in any public park or park areas in the City. The Park and Recreation Department shall cause each of said areas to be posted with signs in such places and in a manner to give reasonable notice to the public of the provisions of this subsection. C. Dogs Leashed: All dogs shall be leashed and attended at all times in any park area, unless in a designated posted leash free park area as designated by the Park and Recreation Board of the City of Mitchell 1 . (Ord. 2396, 3-19-2012)
D. Injuring Trees Or Plants: No person may pluck, destroy, cut, deface, break, trample upon, remove, or interfere with the growth of any tree, shrub, or flower in any park or parkway, unless the Parks and Recreation Director has approved such action in writing prior to its occurrence. (Ord. O2019-04, 4-15-2019)
E. Injuring Property: No person shall deface, mar, injure, break or tamper with any water connection, hydrant, building or other improvement in any park or parkway 2 . (1984 Code § 26-11)
G. Camping In Parks: No person shall park or camp any motor vehicle driven camper or recreational vehicle or pull type camper or travel trailer overnight on any City park or City owned property at Lake Mitchell, including the designated beaches, boat ramps, parks and public access areas, without prior written permission from the Director of Park and Recreation. The following real property currently owned by the City of Mitchell be permanently dedicated for public use as parks, nature trails, biking trails, hiking trails and similar uses, and be preserved to serve as a buffer for surface waters draining into Lake Mitchell:
A. Lot One (1) of North Harmon First Addition, a Subdivision of Government Lot Four (4) and the Southwest Quarter (SW 1/4) of the Northwest Quarter (NW 1/4), all in Section Four (4), Township One Hundred Three (103) North, Range Sixty (60), West of the 5th P.M., Davison County, South Dakota.
B. That part of the North Half of the Northwest Quarter (N 1/2 NW 1/4) Section Five (5), Township One Hundred Three (103) North, Range Sixty (60) West of the 5th P.M., Davison County, South Dakota, lying south and west of South Harmon Drive, and belonging to the City of Mitchell.
C. All City owned property comprising or abutting the shoreline of Lake Mitchell. (Initiative Petition approved 11-2-2010)
Notwithstanding any other section of this code, the change of use of the real properties listed in this section, which are currently owned, held, or otherwise used by the City of Mitchell for parks, parkways, boulevards, public libraries, museums, or art galleries, is hereby authorized pursuant to an affirmative majority vote of the voters of Mitchell, South Dakota, and such real properties listed herein may be used for other purposes or transferred freely by the City of Mitchell as if such real properties had never been owned, held, or otherwise used by the City of Mitchell for parks, parkways, boulevards, public libraries, museums, or art galleries:
A. Lots 35 and 35A, Sunset Point Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
B. Lots 31, 31A, 32, and 32A, Sunset Point Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
C. Lots 22 and 22A, Sunset Point Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
D. Lots 11, 12, and the East half (1/2) of Lot 13, Sunset Point Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
E. Lots 27, 27A, 28, and 28A, Indian Head Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
F. Lots 58, 58-A, and 59, Indian Head Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
G. Lots 80 and 81, except Lot 81-A, Indian Head Subdivision, Lake Mitchell Development Plan, City of Mitchell, Davison County, South Dakota.
