§ 54.05 PRIMARY POWER RATE (SCHEDULE P-P).
   (A)   Applicable: This rate is available, upon application, to power consumers for power, including lighting, where the monthly maximum demand of the consumer is at least 500 kilowatts each and every month of the past 12 (immediate preceding) billing months and where the consumer furnishes and maintains all equipment necessary to receive and utilize all the energy at the primary supply voltage from a point designated by the village. This rate is not available for auxiliary, standby, or supplementary service.
   (B)   Character of service: Any primary voltage designated by the village. Voltages currently available are 12,470 volts. All services are to be three phase, 60 hertz, with balanced three phase loading. All energy shall be primary metered unless the village desires secondary metering in which case the kilowatt-hours and kilowatt and kilovar demands shall be adjusted to reflect consumption as subsequently stated herein.
   (C)   Minimum monthly charge:
      (1)   Three phase: $4,800.
   (D)   Demand charge:
      (1)   First 500 kW or less of billing demand per month: $4,800.
      (2)   Over 500 kW of Billing demand per month, per kilowatt: $9.60.
   (E)   Energy charges:
      (1)   For each kilowatt-hour of billing energy per month: $0.480.
   (F)   Reactive charge:
      (1)   All kilovar of reactive billing demand per month: $0.750.
   (G)   Excise (kilowatt-hour) tax adjustment: For all customers located outside the village’s corporation limits, the rates set forth above shall be increased by an amount equal to excise (kilowatt-hour) tax imposed on the village’s electrical distribution system under R.C. § 5727.81. Such increase shall become effective with the bills that include May 1, 2001 as part of the usage period and shall be automatically adjusted to reflect any change in the kilowatt-hour tax imposed by R.C. § 5727.81.
   (H)   Power cost adjustment: The above rates shall be adjusted in accordance with the power cost adjustment set forth in § 54.07.
   (I)   Delayed payment charge: Ten percent shall be added to the net bill if not paid full within 15 days after rendition of bill for such service.
   (J)   Determination of billing demand: The billing demand shall be in 15-minute integrated demand, ascertained in kilowatts by instruments suitable for that purpose. Billing shall be on a monthly basis and the monthly billing demand shall be the greater of the following:
      (1)   Off-peak: Seventy percent of the greatest such demand occurring during the billing month, either within the period between 11:00 p.m. of one day and 7:00 a.m. the following day or on a Saturday or Sunday, or on New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day; or
      (2)   On-peak: One hundred percent of the greatest such demand occurring during the billing month at anytime not within the period and not on the days specifically mentioned in division (J)(1), above.
   (K)   Service voltage adjustment: These rates are based on metered service at 12,470 volts (primary service). When at the option of the village metering is at a secondary voltage (480 volts or less), the metered kilowatt-hours and metered kilowatt and kilovar demands shall be increased by 1.5% to obtain the billing kilowatt-hours and billing kilowatt and kilovar demands without affecting the minimum monthly charge.
   (L)   Contract requirements: At the option of the village, service under this rate schedule may only be available under a service contract with consideration for size, character and location of the consumer’s load and the amount of facilities to be furnished by the village in serving such load. Contract term initially shall be at least five years.
   (M)   Terms and conditions:
      (1)   All electric service of the village is rendered under and subject to the general service rules and regulations of the village as amended from time to time
      (2)   This rate is only available upon application in writing to the village and with reasonable lead time for implementation.
