(a) Posting of Entrance Lists. The Commission shall prepare and keep open for public inspection an entrance eligible list of the applicants who have received a passing grade on the written examination. Such applicants shall take rank upon the eligible list in the order of their relative grade, including any additional credit for State of Ohio Certification as Emergency Medical Technician-Paramedic for applicants taking the written examination for the position of Firefighter.
(b) Posting of Promotional Lists. The Commission shall prepare and keep open to public inspection from the returns of each examination, a promotional eligible list of the applicants whose grade in the written examination and oral examination or assessment center examination is not less than 70 percent. Such persons shall take rank upon the eligible list in the order of their relative grades including additional credit for seniority.
(c) Whenever it becomes necessary to hold a subsequent examination in order to obtain additional eligibles the Commission may consolidate existing lists for the same class by rearranging the names of those eligible therein according to their grade. All those persons whose names appear on an existing list which is to be merged with a new list shall have an opportunity to compete in the second examination but by so doing, they shall thereby become removed from such existing list and shall be bound by the results of the new examination.
(d) Duration of Lists. The term of both entrance and promotional eligible lists and of the names appearing thereon shall expire one year after certification of the list to the City Manager, except that, upon request of the City Manager, the Commission may conduct entrance examinations and certify a new entrance eligible list prior to expiration of an existing entrance eligible list in which case such new entrance eligible list shall supersede the existing entrance eligible list subject to Section l59.07(c) of this chapter. Prior to the expiration date of an entrance and promotional eligible list, the Commission may extend the term of the entrance and promotional eligible list for one additional period not to exceed one year if such extension is requested by the City Manager. Said extension shall be certified in writing by the Commission to the City Manager.
(e) In the event two or more applicants for original appointment receive the same grade in open competitive examination, priority in the time of filing application with the Commission shall determine the order in which their names shall be placed on the eligible list; provided, that applicants who are veterans from service in the armed forces of the United States as defined in Section 159.08(b) of this chapter shall receive priority in rank on an eligible list over non-veterans on the list with a rating equal to that of the veteran. Ties among veterans shall be decided by priority at the time of filing application with the Commission. In the event of two or more applicants receiving the same grade on a promotional examination, seniority in the position classification from which the promotion is to be made shall determine the order in which their names shall be placed on the eligible list. In the event of two or more applicants having the same seniority in the position classification from which the promotion is to be made, the certified examination score received by such applicants for their currently held position shall determine the order in which their names shall be placed on the eligible list. In the event of two or more applicants having the same certified examination score for their currently held position priority in filing application with the Commission for original appointment shall determine the order in which their names shall be placed on the eligible list.
(f) Transfer to a Lower Class. At the discretion of the Commission, the name of any eligible may, at any time, upon his written request, be transferred to the eligible list for a lower class m the same series requiring qualifications of the same general character. He shall be ranked thereon according to his original grade.
(g) Persons Not Eligible for Appointment. The name of any person appearing on an eligible list who:
(1) Fails to report or arrange within five calendar days (Sundays and holidays excluded) for an interview with the City Manager or the department head;
(2) Fails to respond to a notice from the City Manager;
(3) Previously has declined an appointment without reasons satisfactory to the City Manager; or
(4) Who cannot be located by the postal authorities;
shall not be eligible for appointment. The person shall be notified to this effect unless his whereabouts are unknown. His name may again be certified to the eligible list only in case a thoroughly satisfactory explanation of the circumstances is made to the Commission. In case an eligible person's name appears on more than one list, appointment to a position in one class shall be considered a waiver for appointment from other eligible lists for classes the salary of which is equal or lower. (h) Disqualification of Eligibles. If, at any time after the creation of an eligible list, the Commission has reason to believe that any person whose name appears on any list is disqualified for appointment because of false statements made in his application; errors disclosed in computing the scores; violation of Section l59.06
(i) of this chapter; unsuitability pursuant to Section 159.08
, or other comparable reasons, as determined by the Commission, such person shall be notified and given an appointment to be heard. If such person shall fail to appear for a hearing, or upon being heard, fail to satisfy the Commission, his name shall be removed from such eligible list. Such person may unilaterally and voluntarily elect to remove his name from the eligible list by notifying the Commission of such election in writing or printable medium at any time up to the hearing on his proposed removal from the eligible list.

(i) Change of Address. Each person on an eligible list shall file with the Commission written notice of any change of address, and failure to do so may be considered sufficient reason for disqualification from future appointments.
(j) Revocation of List. An eligible list may be revoked and another examination ordered when in the judgment of the Commission such action is deemed advisable by reason of errors, fraud, or obviously inappropriate standards prescribed in connection with any examination All applicants in the first examination shall be notified and shall be eligible to compete in the rescheduled examination without filing a separate application or the payment of an additional fee. No eligible list shall be altered or revoked except upon written notice to all persons whose standing may be affected and upon an entry in the minutes of the Commission of the reasons for such alteration or revocation.
