159.08 APPOINTMENTS.
   Appointments to all positions in the classified service that are not filled by promotion, transfer, or reduction, as provided by provisions of this chapter shall be made only from those persons whose names are certified to the City Manager in accordance with the provisions of this chapter and who the Civil Service Commission has determined to be suited for appointment based upon the criteria established pursuant to Sections 159.06 (d)(1)E., F., G., H.     (a)    Number of Names to Be Certified: Appointment from other Appropriate Lists. The City Manager shall notify the Commission of an entrance position in the classified service that is to be filled and the Commission shall, except as provided for in Section 159.08 (h) of this chapter, certify to the City Manager the names and addresses of the applicants standing highest on the eligible list for the class to which said position is classified in the following manner:
      The City Manager shall have discretion in appointing any:
      1 appointment from a list of 3 names
      2 appointments from a list of 5 names
      3 appointments from a list of 7 names
The above list of certified names shall be known as the “Highest Standing List” and shall expire after (2) months of existence or at such earlier time as recommended by the City Manager and approved by the Commission.
No applicant shall be certified more than two (2) times to the “Highest Standing List” during the term of the eligibility list, except upon written request by the City Manager. Unless such a written request is made by the City Manager after an applicant has been twice certified to the “Highest Standing List” the applicant’s name shall be removed from the eligible list.
In the event that an entrance eligible list becomes exhausted, and until a new list can be created, new appointments must be of a temporary nature and automatically be terminated when a new entrance eligible list is available except as specified in Section 159.08 (h) of this chapter.

   (b)   Preference to Persons for Military Service. Every Soldier, Sailor, Marine, Coast Guardsman, member of the Auxiliary Corps as established by Congress, member of the Army Nurse Corps, or Navy Nurse Corps, or Red Cross nurse, who has served in the Army, Navy or hospital service of the United States, and such other military service as is designated by Congress or the Selective Service or similar conscriptive acts as are in effect in the United States, who has been honorably discharged or separated under honorable conditions therefrom, and is a resident of Ohio and whose name appears on an eligible list for a position, shall be entitled to preference in original appointment to any such position in the classified service of the City of Mentor over all persons eligible for such appointments and standing on the list therefor with a rating equal to that of such former member of the armed services.
   (c)    One of the Persons Certified to Be Appointed. Upon receipt from the Commission of such list of eligibles for a position, the City Manager shall fill such position by appointment of one of the three persons certified to him and shall forthwith report to the Commission the name or names of such appointees, the title of the position, the duties and responsibilities of same, the salary or compensation thereof, and such other information as the Commission may require in order to keep its roster.
   (d)    Probationary Period; Probationary Removal or Reduction. All original and promotional appointments to the classified service shall be for a probationary period of one year. If the service of the probationary employee is unsatisfactory as determined by the City Manager, he may be removed or reduced at any time during his probationary period by the City Manager.

   (e)    Permanent Residence. All appointees to entry level positions in the Police and Fire Departments appointed after March 1, 1981 shall secure permanent residence in Ohio, Lake County, or a county contiguous to Lake County or within a 70 mile radius of the City of Mentor no later than 18 calendar months after their appointment and shall continue to reside within such area while employed by the City of Mentor while in the classified service in the Police and Fire Departments. Failure to establish permanent residence as specified herein shall be grounds for dismissal from the classified service.

   (f)    Restriction to Age, Physical or other Requirement. Any restriction for appointment from an eligible list as to age, physical or other requirements shall be made prior to and stated in the bulletin announcing the examination and no eligible list shall be so restricted unless it had been announced in the examination bulletin.
   (g)    Emergency Original Appointments. In case of an emergency, as determined by the City Manager, an original appointment may be made without regard to the provisions of this chapter, but in no case to continue longer than ninety (90) days and in no case shall successive original appointments be made; provided, however, that interim or emergency original appointments, made necessary by reason of sickness, disability, or unavailability of a regular employee, may exceed ninety (90) days, but shall continue only during such period of sickness, disability or unavailability. The acceptance or refusal of an emergency original appointment by an eligible shall not affect his standing on the register for permanent appointment; nor shall the period of emergency service be counted as part of the probationary service in case of subsequent appointment to a permanent position. All such emergency original appointments shall be promptly reported to the Commission by the City Manager.
   (h)    Promotions. Vacancies in positions above the entrance level in the classified service shall be filled, insofar as practicable, by promotions. Unless otherwise specified herein, promotion of classified personnel other than emergency or temporary promotions shall be made in accordance with Section 159.06(e) and (f) of this chapter.
The City Manager shall notify the Commission in writing of a particular promotional position in the classified service that is to be filled and the Commission shall, except as provided for in Section 159.08 (i) of this chapter, certify to the City Manager the name of the applicant standing highest on the eligible list for the class to which said position is classified. The City Manager shall appoint such person within thirty days from the date of such certification.
If there is no eligible list for such position, the Commission shall, within sixty days of written notification by the City Manager, hold a competitive written examination and within ninety days hold an oral or assessment center examination. After such examinations have been held and an eligible list established, the Commission shall certify to the City Manager the name of the applicant standing highest on the eligible list for the class to which said position is classified. The City Manager shall appoint such person within thirty days from the date of such certification.
In the event that a promotional eligible list becomes exhausted, and until a new list can be created, new promotions must be of a temporary nature and automatically be terminated when a new eligible list is available except as specified in Section 159.08 (i) of this chapter.
   (i)    Emergency and Temporary Promotion. Emergency or temporary promotion of a member of the classified Civil Service to a higher rank or position within the classified service may be made without examination by the City Manager for a period not to exceed 180 days, and in no case shall successive emergency temporary promotions be made. However, an emergency or temporary promotion as hereinbefore defined, made necessary by reason of sickness, disability or unavailability of a regular employee may be extended by the Civil Service Commission in excess of 180 days but shall continue only during the period of sickness, disability or unavailability.    (j)   Political Activity. An applicant or appointee to the civil service may engage in seeking or holding partisan or nonpartisan municipal legislative office so long as the applicant or appointee seeks or holds such elective office outside of the boundaries of Lake County, Ohio.
