The Town Commission may waive the restriction set forth in § 61-55, if it finds that:
(1) The proposed use will not be contrary to the public interest or injurious to nearby properties, and that the spirit and intent of this chapter will be observed;
(2) All appropriate regulations of this chapter will be observed; and
(3) The proposed use will not be contrary to any adopted neighborhood redevelopment plan or the Comprehensive Plan nor contrary to any downtown redevelopment program.
