§ 97.02 BOARD OF PARK COMMISSIONERS.
   (A)   Members. The Department of Public Parks shall be under the control of a board of four members, not more than two of whom shall be of the same political party, to be appointed by the Mayor, and to be known as the Board of Park Commissioners. The Board of Park Commissioners may serve with compensation that is permitted pursuant to all applicable state statutes and rules.
   (B)   Term of office. As set forth in IC 36-10-4-3 and 36-10-4-4, the first members of the Board of Park Commissioners shall hold office respectively as follows: one for the term of one year; one for a term of two years; one for a term of three years; and one for a term of four years, from and after the first Monday of January of the year of their appointment. Annually thereafter, on or before the first Monday of January in each year, the Mayor shall appoint a Commissioner to fill the vacancies caused by such expiration, and the Commissioner so appointed shall hold office for a term of four years, beginning with the first Monday of January in the year of the appointment, and if any vacancy occurs in such Board, by resignation or otherwise, the Mayor shall appoint one or more Commissioners for the residue of the term or terms. No Commissioner shall be removed from office except upon charges first preferred in writing before the Mayor or as otherwise set forth in IC 36-10-4-4. A hearing shall be had thereon as required under IC 36-10-4-4, and nothing shall be deemed sufficient cause except inefficiency, neglect of duty, or malfeasance in office.
   (C)   Officers, meetings, and procedures. The Board of Park Commissioners shall, at its first regular meeting in February, choose one of its members President and another of its members Vice-President as set forth in IC 36-10-4-7. On or before the first day of February of each year the Board shall make a report to the Mayor of its proceedings with a full statement of its receipts and disbursements for the preceding calendar year. Money received by the Board shall be paid into the City Treasury and credited to the Department of Public Parks. All expenditures relating to the parks, parkways, and public grounds under the control of such Department shall be provided for by the special levy of taxes and paid from the City Treasury when ordered by said Board as hereinafter provided. A majority of the Board shall constitute a quorum and no action of such Board shall be binding unless authorized by at least three members present and acting at a regular or duly called special meeting thereof, as set forth in IC 36-10-4-7(b).
   (D)   The Board of Park Commissioners shall have the powers and duties as set forth in IC 36-10-4-9 and 36-10-4-11.
