§ 97.01 ESTABLISHMENT OF DEPARTMENT.
   There is hereby established an executive department of the city to be known as the Department of Public Parks for the control and management of public parks of the city.

§ 97.02 BOARD OF PARK COMMISSIONERS.
   (A)   Members. The Department of Public Parks shall be under the control of a board of four members, not more than two of whom shall be of the same political party, to be appointed by the Mayor, and to be known as the Board of Park Commissioners. The Board of Park Commissioners may serve with compensation that is permitted pursuant to all applicable state statutes and rules.
   (B)   Term of office. As set forth in IC 36-10-4-3 and 36-10-4-4, the first members of the Board of Park Commissioners shall hold office respectively as follows: one for the term of one year; one for a term of two years; one for a term of three years; and one for a term of four years, from and after the first Monday of January of the year of their appointment. Annually thereafter, on or before the first Monday of January in each year, the Mayor shall appoint a Commissioner to fill the vacancies caused by such expiration, and the Commissioner so appointed shall hold office for a term of four years, beginning with the first Monday of January in the year of the appointment, and if any vacancy occurs in such Board, by resignation or otherwise, the Mayor shall appoint one or more Commissioners for the residue of the term or terms. No Commissioner shall be removed from office except upon charges first preferred in writing before the Mayor or as otherwise set forth in IC 36-10-4-4. A hearing shall be had thereon as required under IC 36-10-4-4, and nothing shall be deemed sufficient cause except inefficiency, neglect of duty, or malfeasance in office.
   (C)   Officers, meetings, and procedures. The Board of Park Commissioners shall, at its first regular meeting in February, choose one of its members President and another of its members Vice-President as set forth in IC 36-10-4-7. On or before the first day of February of each year the Board shall make a report to the Mayor of its proceedings with a full statement of its receipts and disbursements for the preceding calendar year. Money received by the Board shall be paid into the City Treasury and credited to the Department of Public Parks. All expenditures relating to the parks, parkways, and public grounds under the control of such Department shall be provided for by the special levy of taxes and paid from the City Treasury when ordered by said Board as hereinafter provided. A majority of the Board shall constitute a quorum and no action of such Board shall be binding unless authorized by at least three members present and acting at a regular or duly called special meeting thereof, as set forth in IC 36-10-4-7(b).
   (D)   The Board of Park Commissioners shall have the powers and duties as set forth in IC 36-10-4-9 and 36-10-4-11.

CITY PARKS
§ 97.15 CERTAIN PARK NAMES.
   (A)   The city park located across from City Hall in the 400 block of West Street is hereby named Lytle Park in honor of Markt A. Lytle, who died in office while serving as Mayor of the City of Madison.
   (B)   The park presently known as North Broadway Park at the site of the old Broadway School is hereby named Gaines Park in honor of Reverend S. M. Gaines, minister of the Broadway Second Baptist Church.
   (C)   The park at the foot of Michigan Hill bounded by Sixth Street and west of West Street is hereby named Yunker Park in honor of the Yunker family who donated the park to the city.
   (D)   The city park located on a thirteen-acre tract on Cragmont Street known as the old railroad pond is hereby named Johnson Park in honor of Mr. and Mrs. Richard M. Johnson, who donated the park to the city in honor of Mr. Johnson's father.
   (E)   The park located on the east end of Vaughn Drive that has been commonly referred to as Jaycee Park shall now be named Damon L. Welch Park to honor former Mayor Damon L. Welch and his many contributions to the City of Madison.

§ 97.16 OPENING AND CLOSING HOURS.
   City parks shall be closed from dusk to dawn.

§ 97.17 CERTAIN MOTORIZED VEHICLES PROHIBITED.
   (A)   It shall be unlawful for any person to ride a motorcycle, motor bike, moped, snowmobile, or four-wheel drive vehicle or other motorized vehicle in the city parks.
   (B)   It shall be unlawful for any person to ride a motorcycle, motor bike, moped, four-wheel drive vehicle, snowmobile, or other motorized vehicle on the municipal golf course without the express authorization of the city.

§ 97.18 ALCOHOLIC BEVERAGES PROHIBITED.
   It shall be illegal for any person to possess any alcoholic beverage in any city park, with the exception of Sunrise Golf Course, so long as alcohol is sold pursuant to the rules and regulations of the State of Indiana pursuant to a city owned alcohol permit. Furthermore, alcohol may be permitted at other city parks if said park is utilized for a festival, concert, or other activity that is approved by the City of Madison and all rules and regulations of the State of Indiana are followed to allow the sale or consumption of alcohol.
