§ 55.04 POST-CONSTRUCTION STORMWATER POLLUTION PREVENTION PLAN REVIEW AND APPROVAL.
   The City Engineer shall review the post-construction SWPPP in conjunction with the review of the erosion and sediment control plan as described in §§ 54.08 and 54.09. Possible actions based on the review of the SWPPP shall be the same as described in § 54.09(A) (i.e. approve, approve with conditions, or disapprove). A site development permit as set forth in § 54.08 shall only be issued following the approval of a project's post-construction SWPPP.

§ 55.05 RIGHT OF ENTRY.
   The city shall have the authority to perform inspections of all public or privately owned stormwater quality BMPs. Noted deficiencies and recommended corrective actions will be included in an inspection report and sent to the property owner(s).

§ 55.06 BMP CONSTRUCTION AND MAINTENANCE.
   (A)   It will be the responsibility of the project site owner or developer to ensure proper construction and installation of all stormwater quality BMPs in accordance with the approved post- construction SWPPP. However, all future owners or tenants of properties with stormwater quality BMPs must maintain those facilities in accordance with the approved SWPPP and the requirements of this chapter.
   (B)   If a responsible party fails or refuses to adequately maintain a stormwater quality BMP, the city, after reasonable notice, may address those maintenance needs by performing all reasonably appropriate work to place the facility in proper working condition. Costs for performing such work shall be charged to the responsible party as set forth in § 54.11(B).

§ 55.07 ADMINISTRATION AND ENFORCEMENT.
   Administration and enforcement of this chapter shall be the same as set forth in §§ 54.11 through 54.17.
