1.16.030   Minimum penalty for repeated offenses.
   In any case where any section of this code or other ordinance of the city shall not provide the greater penalty for a second or subsequent conviction of a violation thereof, any person violating the same, who shall previously have been convicted of a violation thereof, shall be subject to a fine of not less than ten dollars nor more than two hundred dollars for each offense; except that where the penalty provided by this code for a first violation thereof shall be larger than the penalty provided by this section, such larger penalty shall be applicable. 1.16.040   Failure to pay penalty— Imprisonment.
   When a fine shall be imposed for the violation of this code, the court may also sentence the defendant to pay the cost of the action and to be imprisoned until such fine and costs are paid. In no case, however, shall such imprisonment exceed ninety days and the court may also issue an execution against the property of the defendant for such fine and costs. (Prior code § 5-2-15)
1.16.050   Credit towards fine for each day imprisoned.
   Whenever any person is committed to prison for nonpayment of any fine or costs, or both, he shall be credited with five dollars a day in reduction of the fine. When the person has remained imprisoned a sufficient length of time to extinguish the fine or costs, or both, computed at this rate, the officer having the prisoner in custody shall discharge him from custody under commitment. 1.16.060   Inability to pay fines.
   If the person in custody makes an affidavit that he has no property out of which he can pay the fine and costs, either or any part, the prisoner shall not be retained in custody longer than three months. The affidavit shall be delivered to the officer having custody of the prisoner. (Prior code § 5-2-17)
