The civil service of the City is divided into the unclassified and classified service.
(a) The unclassified service shall include:
(1) All officers elected by the people.
(2) The members of all appointed boards, commissions and advisory boards.
(3) All heads of departments and deputies, with exception of Police and Fire Departments.
(4) The secretary to the Mayor.
(5) The Clerk, and any employees, of the Council.
(6) The employees of the Department of Law.
(7) Deputy City Auditors.
(b) The classified service shall comprise all other positions not specially listed in the unclassified service above.
(c) Any department head or deputy selected from the classified service shall be eligible, for a period of two years from the date of such selection, for reinstatement to the person's previous classified civil service position (or an equivalent position as determined by the Civil Service Board) if the position is open.

For the uses and purposes of this chapter, the positions and classifications hereinafter set forth are hereby authorized, created and established, and the incumbent of each such position and classification shall receive the salary, pay range, or compensation set opposite each position and classification, payable as determined by the City Auditor, except as may be otherwise provided herein, by other ordinances, by applicable collective bargaining agreement, by an appointing authority for unclassified employees not to exceed the amount authorized herein, or by the City Charter. No person shall be entitled to employment or compensation whose position is not set forth in this chapter or as permitted by other ordinance, by applicable collective bargaining agreement, or by the City Charter.
