(A) On or before the first Monday in October in each year hereafter, it shall be the duty of the city commission to pass and finally adopt resolutions levying and assessing all of the property within each lighting district for the entire cost of maintenance, installation, administration and the furnishing of electrical current to or for such lighting district. All of the lighting districts within the city may be addressed in a single resolution, so long as the requirements of section 7-12-4328, Montana Code Annotated are met. Furthermore, the notice and hearing provisions of sections 7-12-4329 and 7-12-4330, Montana Code Annotated shall be complied with. (Ord. 1531, 4-15-1985; amd. Ord. 1664, 1-3-2000)
(B) If all of the city's lighting districts are addressed in a single resolution, such resolution shall clearly specify the total annual assessment for each individual lighting district.
(C) The annual resolutions or resolution of assessment shall contain a list in which shall be described each lot or parcel of land; such lot or parcel's square footage or linear feet, depending upon the method of assessment, and the amount of the annual assessment against each such lot, or parcel. This list may be computer generated and attached to any such resolution. (Ord. 1531, 4-15-1985)
(A) For each lighting district created or re-created by the terms of this chapter, a fund shall be established which shall be known as the special improvement lighting district no. fund, the number of which shall correspond with the number of the lighting district for which costs of maintenance and supplying of electrical current are levied. (B) Through the process of review established by this chapter, the city commission may direct revision or correction of existing bookkeeping practices. (Ord. 1531, 4-15-1985; amd. Ord. 1664, 1-3-2000)
If it is determined by the city engineer that any streetlight or lights should be installed in or removed from any existing or re-created district, or that the level of service be changed or improved in any way in any district, such shall be accomplished by the passage of a resolution. Any such action shall not increase the total annual assessment for such district. However, any such costs may be paid from reserve funds. (Ord. 1531, 4-15-1985)
This chapter shall become effective thirty (30) days after passage. The procedures herein, including the preparation of a preliminary or final report, may be instituted from time to time as deemed necessary in accordance with the purpose of this chapter. Any of the procedures herein, which are instituted prior to the effective date of this chapter, shall be recognized as valid and binding, so long as no resolution is passed prior to such effective date.
