Excepting where such person is operating under a contract with the city involving the opening of a public way, any person desiring to excavate in or cut through or tear open the surface of any street, avenue, alley, sidewalk, boulevard, or other public way within the city, shall first file his written application with the building official. The application shall state the object sought, the purpose for which the public way is to be excavated in, cut through, or broken open, the proposed area of such opening and the exact location thereof. The application shall be accompanied by the applicable following fee payable to the city:
(A) For an opening not exceeding forty feet (40') in length, there shall be and is a minimum fee of twenty dollars ($20.00).
(B) For an opening exceeding forty feet (40') in length, there shall be and there is a fee of twenty dollars ($20.00) plus twenty five cents ($0.25) per linear foot in excess of forty feet (40') in length. (Ord. 1469, 12-15-1980)
The building official may, in his discretion, grant or refuse to grant such permit. The refusal of the building official to grant any such permit is subject to review by the city commission. The applicant shall accomplish the proposed work in the time allowed by the building official, shall thoroughly backfill any such excavation or opening and restore the surface thereof to the condition it was prior to such excavation or opening.
