The express purpose of this chapter is to ensure maximum public enjoyment of the parks and other public lands placed under the authority of the park and recreation board. To this end, the rules and regulations contained herein are intended to promote the health, safety, and orderly use of the city parks and lands by the public. (Ord. 1720, 6-2-2008)
The terms of this chapter shall apply to all existing and hereafter acquired parks within or outside the boundaries of the city. It shall also apply to those public lands within or outside the boundaries of the city, owned by the city, and placed under the authority of the park and recreation board by the city commission. The park and recreation board shall have the authority to promulgate or approve rules and regulations for any specific park or public lands placed under its jurisdiction, so long as such rules and regulations are not inconsistent herewith. The park and recreation board shall be responsible for operation of such city parks, however, its authority may be delegated as it deems necessary. (Ord. 1720, 6-2-2008)
(A) It shall be unlawful for any person to perform any of the following acts within city parks or public lands:
1. Wilfully mark, deface, disfigure, injure, tamper with, or displace or remove, any buildings, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards whether temporary or permanent, monuments, stakes, posts, or other boundary markers or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
2. Bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, or refuse, or other trash. No such refuse or trash shall be placed in any waters in or contiguous to any park or public lands, or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided; where receptacles are not so provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere.
3. Disturb the peace.
4. Endanger the safety of any person by any conduct or act.
5. Commit any assault, battery, or engage in fighting.
6. Camp or otherwise stay overnight in any park or public lands, unless authorized by the park board or its authorized representative.
7. To drive or operate, leave, park, or repair any motor vehicle upon, across or onto any park or public lands. The foregoing shall not apply to vehicle use in designated parking areas, or vehicle use by authorized city employees for purposes of park maintenance or operation.
8. To trespass or otherwise come upon the swimming pool area when the pool is closed or not under proper supervision.
9. To bring, leave or otherwise cause any domestic animal to come onto any park or public lands, except as specifically designated and specified by the park and recreation board. The foregoing shall not limit or invalidate any other ordinance regarding animals.
10. To paste, glue, tack or otherwise post any sign, placard, advertisement, inscription or sign.
11. To build any fire except in established fireplaces or portable units brought in or set up for the purpose of fireplaces or broilers. Authorized fires shall be attended at all times.
12. To discharge any firearm or other weapon.
(B) The park and recreation board shall have authority to establish other rules for the use of parks and public lands under its control which shall be enforced as ordinances of the city. (Ord. 1720, 6-2-2008)
