§ 51.01  EXTENSION OF SERVICE PROHIBITED.
   No further extensions of water and sewer facilities shall be made outside of the corporate boundaries of the village, except that the council of the village shall accept written application for such extensions from time to time.  The council shall have the power to grant or reject such applications for such extensions in their discretion, and may require compliance with such standards as they may establish from time to time as a condition to granting any such extensions.

§ 51.02  EXTENSION TO VILLAGE OF WEST LEIPSIC.
   (A)   Extension of the water system of the village is hereby authorized in order that water may be furnished to the residents and citizens of the Village of West Leipsic.
   (B)   This section does not grant a permanent right to the Village of West Leipsic or to its residents and citizens and the water system may be terminated at any time by the Village of Leipsic.
   (C)   This section is an exception to former ordinances prohibiting such extensions beyond the municipal boundaries of the village.

§ 51.14  RENTAL ACCESS FEE.
   (A)   A rental access fee of $25 shall be charged to restore water service to any village customer whose water services have been discontinued.  Said rental access fees require a 24-hour advance payment of date the service is to begin. Any customer requesting either water access or discontinuance sooner than the 24-hour advance time must pay an additional $10 fee for either service or $20 for both. Said fee or fees will not be charged to discontinue or restore service when repairs are required to the water supply line from the curb stop (valve) to the point where the water supply line enters any structure.
   (B)   Leipsic water customers with established good credit need not pay the access fees in advance. The village will bill these individuals on their next monthly statement.
   (C)   There will not be an additional charge for new water service connections as the rental access fee shall be included in the water tap fee.

§ 51.16  SEWER SERVICE RATES AND CHARGES.
   (A)   Purposes of charges.
      (1)   For the purpose of providing for the cost of the management, maintenance, operation, and repair of the system, for the enlargement or replacement of the system, and the payment of principal of and interest on any debt incurred in connection therewith, there is hereby levied and assessed upon each lot, parcel of land, or premises in the village on which a discharge unit is located, a sewer service charge as hereinafter provided. All classes of users shall be levied charges on the same basis as described hereinafter.
      (2)   The user charge portion of the sewer service charge shall be calculated on the volume of wastewater discharged into the system and shall be measured by the water used by each discharge unit as shown by village water meter readings.
   (B)   Sewer service rates.
      (1)   The sewer service charge for all users shall consist of a debt service charge of $20.20 per month and a user charge of $1.60 per 100 cubic feet or portion thereof. The minimum monthly charge for residents of the Village shall be $25.00 based on an assumed water use of 300 cubic feet.
      (2)   A 50% surcharge for users located outside the village shall be added to the monthly debt service charge. The minimum monthly charge for users located outside the village shall be $37.50.
   (C)   Multiple Units. If more than one discharge unit is served by a single water meter, each discharge unit shall be required to pay the minimum sewer service charge, regardless of metered water use. For connected units without metered water, the user charge shall be levied based on the unit equivalent flow value on the property being served as determined by the village.
   (D)   Billing. Bills for sewer service will be rendered on the first day of each month. All bills shall be payable on or before the fifteenth day of the month following the month in which the bill is rendered.
   (E)   Unit equivalent. The sewer service charge calculation for unmetered uses shall be related to the concept of “unit equivalent” charges which shall be based on the specific use of each discharge unit. For the purpose of this regulation, one “unit”, shall be equivalent to one single-family dwelling and also to 600 cubic feet per month of sanitary flow. The “use” of a connected property or building unit shall be determined by the village in accordance with local zoning requirements, building codes, and health regulations and will be subject to occasional reevaluation if a change in property use occurs due to remodeling, new construction, change of ownership, or other possible usage change or at the determination of the village.
   (F)   Private water supply. Where a private water supply is used, the sewer service charge may be calculated by requiring the property owner to meter the private water supply, such metering to be at the property owner's expense and such measurement to be used in the same manner as a public water meter in determining the charge. Prior to installation of the meter, the type of equipment installed and its location must be approved by the village. Prior to placing the meter  into use after installation, the village shall inspect and approve the meter installation. Any modifications required by the village shall be made at the user's expense and prior to the meter's use. The meter shall be located in a suitable location that will accommodate readings by village personnel. The village may, at its option, in lieu of such metering, apply a unit equivalent sewer service charge to such premises as defined earlier in this section. Each discharge unit shall be subject to a separate sewer user charge even though such establishment may be served by a sewer connection common to other premises. If the water metered for any user is greater than that actually being discharged into the system, the village may modify and adjust the volume used in calculating the user charge in accordance with the facts, but no charge less than the minimum shall be made for any user subject to the user charge.
   (G)   Surcharge based on high strength wastewater. High strength wastewater discharged into the system as determined by this chapter shall be subject to a monthly surcharge determined on the basis of the following formula:
   Monthly Surcharge = A x B plus C x D where
      A =    $ 0.24 per lb. BOD/yr.
      B =   pounds of biochemical oxygen demand per month in excess of 250 mg/l concentration in the wastewater.
      C =   $0.24 per lb. SS/yr. and
      D =   pounds of suspended solids per month in excess of 250 mg/l concentration.
      (1)   In the above formula A and B are related to the total expenditure per pound of BOD and suspended solids, to collect, convey and treat this type of wastewater.
      (2)   Monthly Surcharge = $O.24 per lb. for oil and grease in excess of 50 mg/l concentration.

§ 51.17  MULTIPLE UNITS.
   Where one water meter is installed to supply service to two or more residential, commercial, or any combination of residential and commercial units, then the monthly appropriate readiness to serve rate shall be applied to each such residential or commercial unit being served by said water meter, in addition to the total monthly water usage charge.  This procedure shall apply to all multiple unit water customers except the Otterbein-Leipsic Retirement Community, who shall be charged one readiness to serve rate per water meter plus the total monthly water usage charge. This exemption is in accordance with the incentive agreement established between the village and the Otterbein-Leipsic Retirement Community.

§ 51.18  BILLINGS.
   Bills for water service will be rendered on the fourth day of each month.  All bills shall be payable on or before the fifteenth of the month in which the bill is rendered.

§ 51.19  DELINQUENT ACCOUNTS.
   A rental increase of 10% will be added to water bills not paid when due.  In the event that a delinquency in payment continues for a period of 30 days after the due date an additional 10% of the balance due shall be added to the delinquent balance; the said penalty shall be on the previous balance of penalties as well as the delinquent charges for water and sewer and will be added for each and every month the said balance remains delinquent.  After written notice from the village to the utility customer that his or her account is more than 30 days delinquent, water utility service will thereupon be discontinued and will thereafter be resumed only upon full payment of the entire amount due plus penalties and the required turn-on fees.

§ 51.20  LIEN FOR DELINQUENT SEWER CHARGES.
   The discharge unit connected to the system or having such connection available shall be liable to the village for any charge or fee levied by § 51.16. Each charge levied pursuant to § 51.16 is hereby made a lien upon the premises charged therewith, and if the same is not paid within 90 days after it shall be due and payable, it shall be certified to the County Auditor, who shall place the same on the tax duplicate, with the interest and penalties allowed by law, and shall be collected as other village taxes are collected.
