It shall be unlawful to place any garbage in any container unless the same shall be wrapped in a paper wrapping or bag.

It shall be unlawful to place or permit to remain anywhere in the city any natural debris or refuse too bulky to place in containers, except on or immediately adjacent to a public street or alley preparatory to having the material collected and disposed of by the city, or in a lawfully established dump or except upon a special permit having been issued after application to the Clerk-Treasurer.

(A) It shall be lawful in the commercial areas of the city to dispose of refuse and natural debris, but not garbage, in trash bins, which shall consist of enclosed metal or wooden structures, except that material placed in trash bins shall be placed therein in boxes or containers and shall not be loosely thrown therein.
(B) The owner or operator of any business establishment in the city shall build in an alley adjacent or reasonably close to his or her establishment an enclosed metal or wooden structure for use as a trash bin, unless the amount of trash, boxes and containers which the business establishment accumulates is small enough in quantity and bulk to be contained within a container.

(A) It shall be unlawful for any person to collect garbage, papers, trash or other debris in the city unless his or her wagon, truck or cart has a leakproof body or bed. The body or bed must be lined with tin, sheet iron or other metal and welded or put together in a way that the bed or body will not leak. The body or bed shall also be so constructed that a top can be fitted on the body or bed of the wagon, truck or cart in a way as to prevent any trash, garbage, paper or debris from falling off of the wagon, truck or cart and shall be made of wood, tin, galvanized iron or heavy canvas.
(B) Every person engaged in collecting garbage, paper, trash or debris in the city shall use due care to prevent it from blowing away from the body of the truck, wagon or cart.

(A) Any mass or accumulation of garbage, refuse and natural debris other than natural debris deposited by the wind and natural forces, on any property within the city in violation of this chapter is hereby declared to be a nuisance.
(B) The owner or occupant of the property upon which the nuisance is found shall be ordered by the Street Department and Building Inspector to abate the same, not later than a date to be stated in a written notice ordering the abatement.
(C) Upon the failure of the occupant to abate the nuisance, the Street Department and Building Inspector may enter upon the premises and abate the same, the costs of which shall be assessed against the owner of the property, and, if not paid within 30 days after notification thereof, the city may impose a lien upon the property for the expense and shall place the same upon the tax duplicate in the office of the County Treasurer for collection as provided by law.

The fact that garbage, refuse or natural debris is found on any property or in any street in the city shall be prima facie evidence of the fact that the person responsible for the deposit thereof, or the occupant of the property, is guilty of the violation of this chapter so occurring.

OPEN BURNING
(B) No open burning shall be allowed unless the City Fire Department has been notified at least 24 hours in advance of the date, time and location of the burning.
(C) No open burning of leaves shall be permitted.
(D) A person who openly burns any materials shall extinguish the fire if the fire creates a nuisance or fire hazard.
(E) All fires must be attended to at all times during the burning until the fires are completely extinguished and the burning shall be conducted only during daylight hours and all fires shall be extinguished prior to sunset.
(F) Burning may not be conducted during unfavorable meteorological conditions such as high winds, temperature inversions or air stagnation.
(G) No asbestos-containing, materials are permitted to be burned.
(H) All burning must comply with all state and federal laws and, in particular, any regulations promulgated by the Air Pollution Control Board.
