Any person desiring to actively engage in the business of heating and ventilating or electrical wiring in the city shall file in the office of the City Clerk-Treasurer an application and a $50 application fee, this is a nonrefundable fee, to take the examination giving the name and place of business of individual, firm or corporation of which the applicant is a member. The application shall state that the applicant is a master of his or her trade and that he or she is willing to be governed in all respects by all rules and regulations that have heretofore been or may hereafter be adopted by the city pertaining to the above set out businesses.

(A) Each applicant for the license required by § 92.045 shall, at the time of filing his or her application, agree to appear before an examining board pertaining to his or her respective business, composed as set out in this chapter, for examination of his or her qualifications and experience in business; provided, that, in the event the applicant is a firm or corporation, some member of the firm or officer of the corporation shall appear before the examining board. After an examination, which may be written, the applicant shall check with the Building Inspector’s office the next day for the results of the examination. Passing grade is 75%. The examining board will then send the passed test to the Common Council with the recommendation whether to grant or deny the license.
(B) In the event an applicant fails an examination, he or she must wait 30 days before again making a new application to take the examination. If he or she should fail the test again, he or she will need to wait six months to make a new application for the examination. The new application shall be accompanied by a new application fee.

Upon receiving the results of the examination, the applicant for the license required by § 92.045 shall, if the recommendation of the examining board is to grant the license, deposit with the City Clerk-Treasurer a bond in the sum of $10,000, conditioned that the applicant will indemnify and save harmless the city from all liability and damages caused by his or her negligence or carelessness in the performance of his or her work at the trade in which the applicant is licensed; and conditioned further that the applicant will pay fines that may be imposed upon him or her for violation of any of the rules or regulations of this code. The applicant shall also exhibit a certificate of a policy of liability insurance to indemnify third parties for any damages they might suffer as a result of his or her work. Heating and ventilation will also furnish refrigerant and recovery certificate.

Upon approval of the bond, insurance policy and refrigerant transition and recovery certificate and the granting of a license by the Common Council, the Clerk-Treasurer shall issue a license authorizing the applicant for the license required by § 92.045 of this chapter to operate and do business in the city in accordance with his or her license, and for which the applicant shall pay to the Clerk-Treasurer a fee of $30; provided, that the license may be renewed each consecutive year thereafter by the applicant upon the payment of a fee of $30 and upon satisfactory compliance with the provisions of the code; provided further, that if no complaints have been received against the applicant’s work as set out in § 92.051 of the chapter, the applicant for a renewal license shall not be required to appear before the examination board.

The Common Council shall have the power to revoke a license or registration granted under this chapter upon complaint by the Director of Planning and Development and proof that the applicant has failed to meet the minimum requirements as set out in this chapter.

No license required by § 92.045 of this chapter shall be granted for a period of longer than one year and all licenses will expire on December 31 of the year in which they are issued unless sooner revoked for cause as provided in this chapter.

Any nonlicensed contractor shall be required to pass an examination to receive a license from the city before doing work within the city, as outlined in § 92.045 of this code. Further, any nonlicensed contractor shall further be subject to the examination, bonding and insurance requirements as set forth is this chapter prior to the commencement of work within the city. The Building Inspector’s office of the city shall be responsible for the issuance of guidelines and permits, as well as advising nonlicensed contractors of the requirements of this section.
