For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALLEY. A public way within a block, generally giving access to the rear of lots or buildings and not used for general traffic circulation.
ANTIQUE VEHICLE. A motor vehicle that is more than 25 years of age or a bona fide replica thereof and which is driven on the highways only going to and returning from an antique auto show or an exhibition, or for servicing or demonstration, or a firefighting vehicle more than 20 years old which is not used as firefighting equipment but is used only for the purpose of exhibition or demonstration.
ARTERIAL STREET. Any United States or state numbered route, controlled access highway or other major radial or circumferential street or highway designated by local authorities within their respective jurisdictions as part of a major arterial system of streets or highway.
AUTHORIZED EMERGENCY VEHICLE. Emergency vehicles of municipal departments or public service corporations as are designated or authorized by proper local authorities; police vehicles; vehicles of the Fire Department and ambulances.
BICYCLE. Every device propelled by human power upon which any person may ride, having two or more tandem wheels.
BUS. Every motor vehicle, other than a commuter van, designed for carrying more than ten passengers and used for the transportation of persons; and every motor vehicle other than a taxicab, designed and used for the transportation of persons for compensation.
BUSINESS DISTRICT. The territory contiguous to and including a highway, when within any 600 feet along such highway there are buildings in use for business or industrial, purposes, including, but not limited to, hotels, banks or office buildings, railroad stations and public buildings which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the highway.
CAMPER. A recreational motor vehicle of the Second Division converted or equipped and primarily used for living quarters or for human habitation, rather than for the transportation of freight, goods, wares and merchandise and not used as a commercial vehicle.
CANCELLATION OF DRIVER’S LICENSE. The annulment or termination by formal action of the Secretary of State of a person’s driver’s license because of some error or defect in the license or because the licensee is no longer entitled to such license, but the cancellation of a license is without prejudice and application for a new license may be made at any time after such cancellation.
CHAUFFEUR.
(1) All persons employed by another for the principal purpose of driving a motor vehicle;
(2) All persons who drive a school bus transporting children;
(3) All persons employed in connection with the operation of any school, day camp, summer camp or nursery school, who drive any motor vehicle transporting children to or from any school, day camp, summer camp or nursery school;
(4) All persons who drive any motor vehicle when in use for the transportation of persons or property for compensation; and
(5) All persons who drive a commuter van while transporting persons to and from their place of employment.
CONTROLLED ACCESS HIGHWAY. Every highway, street or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same, except at such points only and in such manner as may be determined by the public authority having jurisdiction over such highway, street or roadway.
COMMERCIAL VEHICLE. Any vehicle operated for the transportation of persons or property in the furtherance of any commercial or industrial enterprise, for-hire or not-for-hire, not including, however, a commuter van or a recreational vehicle not being used commercially.
COMMUTER VAN. A motor vehicle having a capacity of 12 to 15 persons owned or leased by a company or an employee organization and operated on a non-profit basis with the primary purpose of transporting employees of the company between the employees’ homes and the company’s place of business or a public transportation station and in which the operating, administrative, maintenance and reasonable depreciation costs are paid principally by the persons utilizing the van.
CROSSWALK.
(1) The part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway; and
(2) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface placed in accordance with the provisions in the Manual adopted by the Department of Transportation.
DEALER. Every person engaged in the business of acquiring or disposing of vehicles or their essential parts and who has an established place of business for such purpose.
DRIVER. Every person who drives or is in actual physical control of a vehicle.
ESSENTIAL PARTS. All integral and body parts of a vehicle of a type required to be registered hereunder, the removal, alteration or substitution of which would tend to conceal the identity of the vehicle or substantially alter its appearance, model, type or mode of operation.
EXPLOSIVES. Any chemical compound or mechanical mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in such proportions, quantities or packing that an ignition by fire, by friction, by concussion, by percussion or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructive effects on contiguous objects or of destroying life or limb.
FARM TRACTOR. Every motor vehicle designed and used primarily as a farm implement for drawing wagons, plows, mowing machines and other implements of husbandry, and every implement of husbandry which is self propelled.
FLAMMABLE LIQUID. Any liquid which has a flash point of 700°F or less, as determined by a tagliabue or equivalent closed-cup test device.
FLEET. One or more commercial motor vehicles.
FLEET SAFETY VEHICLE. Any motor vehicle which is used to supervise operations of vehicles of the Second Division on the highway so as to promote safety and legal operations of such Second Division vehicle.
FOR-HIRE. The operation of a vehicle for compensation and subject to federal regulation by the Interstate Commerce Commission or to state regulation by the Illinois Commerce Commission.
FOREIGN VEHICLE. Every vehicle of a type required to be registered hereunder brought into this state from another state, territory or country other than in the ordinary course of business by or through a manufacturer or dealer and not registered in this state.
GROSS WEIGHT. The weight of a vehicle whether operated singly or in combination without load plus the weight of the load thereon.
HIGHWAY. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
HOUSE CAR. A recreational motor vehicle of the First Division converted or equipped and primarily used for living quarters or for human habitation, rather than as a passenger car and not used as a commercial vehicle.
HOUSE TRAILER.
(1) A recreational trailer or semi-trailer equipped and used for living quarters or for human habitation (temporarily or permanently) rather than for the transportation of freight, goods, wares and merchandise; or
(2) A house trailer or a semi-trailer which is used commercially (temporarily or permanently), that is, for the advertising, sales, display or promotion of merchandise or services, or for any other commercial purpose except the transportation of property for hire or the transportation of property for distribution by a private carrier.
IDENTIFYING NUMBER. The numbers and letters, if any, on a vehicle designated by the Secretary of State for the purpose of identifying the vehicle.
IMPLEMENT OF HUSBANDRY. Every vehicle designed and adapted exclusively for agricultural, horticultural or livestock raising operations, including farm wagons, wagon trailers or like vehicles used in connection therewith, or for lifting or carrying an implement of husbandry provided that no farm wagon, wagon trailer or like vehicle having a capacity of more than 400 bushels or a gross weight of more than 30,000 pounds, shall be included hereunder.
IMPROVED HIGHWAY. Any roadway of concrete, brick, asphalt, macadam and crushed stone or gravel.
INTERSECTION. The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict.
(1) Where a highway includes two roadways 40 feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection.
(2) The junction of an alley with a street or highway does not constitute an intersection.
INTERSTATE or INTERSTATE COMMERCE. Transportation between two or more states or transportation originating in one state, and passing into or through other states for delivery in another state, and which is not intrastate.
INTRASTATE OR INTRASTATE COMMERCE. Transportation originating at any point or place within this state and destined to any other point or place within this state, irrespective of the route, highway or highways traversed, and including transportation which passes into or through another state before delivery is made within this state, and including any act of transportation which includes or completes a pickup within Illinois for delivery within the state.
LANE-CONTROL SIGNAL. An official traffic control device consisting of an electrically controlled and illuminated signal of a square or rectangular design and employing distinctive colors or symbols used to control the direction of vehicular flow on the particular lane to which the indication applies.
LEASE. A written document vesting exclusive possession, control of and responsibility over the operation of the vehicle in the lessee for a specific period of time as if such lessee were the legal owner.
LICENSE TO DRIVE. Any driver’s license or any other license or permit to operate a motor vehicle issued under the laws of this state including:
(1) Any temporary license or instruction permit;
(2) The privilege of any person to drive a motor vehicle whether or not such person holds a valid license or permit; or
(3) Any nonresident’s driving privilege as defined herein.
MANUFACTURER. Every person engaged in the business of manufacturing and assembling vehicles or reconstructed vehicles, or engine and driveline components for vehicles.
MERGING TRAFFIC. A maneuver executed by the drivers of vehicles on converging roadways to permit entry into the junction thereof, wherein the driver of each vehicle involved is required to adjust his or her vehicular speed and lateral position so as to avoid a collision with any other vehicle.
METAL TIRE. Every tire the surface of which in contact with the highway is wholly or partly of metal or other hard, nonresilient material.
MOTOR CARRIER. An operator of for-hire vehicles pursuant to the Illinois Motor Carrier of Property Law, being 625 ILCS 5/1-145.
MOTOR VEHICLE. Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. For this chapter, MOTOR VEHICLES are divided into two divisions:
(1) First Division: those motor vehicles which are designed for the carrying of not more than ten persons.
(2) Second Division: those motor vehicles which are designed for carrying more than ten persons, those designed or used for living quarters and those motor vehicles which are designed for pulling or carrying freight or cargo, and those motor vehicles of the First Division remodeled for use and used as motor vehicles of the Second Division.
MOTOR DRIVEN CYCLE. Every motorcycle and every motor scooter with less than 150 cubic centimeter piston displacement including motorized pedalcycles.
MOTORCYCLE. Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor.
MOTORIZED PEDALCYCLE. A bicycle type vehicle, which has tires with an overall inflated diameter of 19 inches or more, with fully operative pedals for propulsion by human power, equipped with a power drive system that functions directly or automatically only and not requiring clutching or shifting by the operator after the drive system is engaged, and a helper motor with a cylinder capacity not exceeding 50 cubic centimeter displacement, which produces no more than 2.0 brake horsepower, and is capable of propelling the vehicle at a maximum speed of no more than 30 mph on level ground.
MULTIPURPOSE PASSENGER VEHICLE. A passenger carrying vehicle which is constructed either on a truck chassis or with special features for occasional off-road operation.
NONCOMMERCIAL, VEHICLE. Any vehicle that is not a commercial vehicle.
NON-FOR-HIRE. Operation of a commercial vehicle in furtherance of any commercial or industrial enterprise but not for-hire.
NONRESIDENT. Every person who is not a resident of this state.
NONRESIDENTS DRIVING PRIVILEGE. The privilege conferred upon a nonresident by the laws of this state pertaining to the operation by such person of a motor vehicle, or the use of a vehicle owned by such person, in this state.
OFFICIAL TRAFFIC CONTROL DEVICES. All signs, signals, markings and devices which conform with the State Manual and not inconsistent with this chapter placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic.
OWNER. A person who holds legal title of a motor vehicle, or in the event a motor vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of such motor vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of this chapter.
PARK or PARKING. The standing of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers.
PASSENGER CAR. A motor vehicle of the First Division including a multipurpose passenger vehicle, that is designed for carrying not more than ten persons.
PEDESTRIAN. Any person afoot.
PERSON. Every natural person, firm, copartnership, association or corporation.
PHYSICALLY HANDICAPPED PERSON. Every natural person who has permanently lost the use of a leg or both legs or an arm or both arms or any combination thereof or any person who is so severely disabled as to be unable move without the aid of crutches or a wheelchair.
PNEUMATIC TIRE. Every tire in which compressed air is designed to support the load.
POLE TRAILER. Every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach or pole, or by being boomed or otherwise secured to the towing vehicle, and ordinarily used for transporting long or irregularly shaped loads such as poles, pipes or structural members capable, generally, of sustaining themselves as beams between the supporting connections.
POLICE OFFICER. Every officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
PRINCIPAL PLACE OF BUSINESS. The place where any person transacts his or her principal business, or where he or she makes up and approves his or her payroll, maintains a central file of records and maintains his or her principal executive offices. In the event that not all of these functions are performed in one place, then that place where a majority of such functions are performed or the place where such person does in fact principally transact and control his or her business affairs.
PRIVATE LIVING COACH. A recreational motor vehicle of the Second Division equipped and primarily used for living quarters, human habitation or for mobile living, rather than for the transportation of persons with direct access to the living quarters from the driver’s seat and not used as a commercial vehicle.
PRIVATE ROAD OR DRIVEWAY. Every way or place, in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
RAILROAD. A carrier of persons or property upon cars, other than streetcars, operated upon stationary rails.
RAILROAD-HIGHWAY GRADE CROSSING. The intersection of stationary rails owned or used in the operation of a railroad corporation across a highway.
RAILROAD SIGNS OR SIGNAL. Any sign, signal or device other than an official traffic control device erected in accordance with the laws governing same and intended to give notice of the presence of railroad tracks or the approach of a railroad train.
RAILROAD TRAIN. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars.
RECONSTRUCTED VEHICLE. Every vehicle of a type required to be registered hereunder materially altered from its original construction by the removal, addition or substitution of essential parts, new or used.
RECREATIONAL VEHICLE. Every vehicle originally designed or permanently converted and primarily used for living quarters or for human habitation and not used as a commercial vehicle, including any house car, house trailer, camper or private living coach.
REGISTRATION-REGISTRATION STICKER-REGISTRATION. The registration certificate or certificates, registration plates and registration stickers issued under the laws of this state pertaining to the registration of vehicles.
REGISTRATION STICKER. A device to be attached to a registration plate that will renew the registration and registration plate or plates for a predetermined period not to exceed one year.
RELIGIOUS ORGANIZATION BUS.
(1) Every motor vehicle, except as provided in division (2) below, owned or operated by or for a religious organization or denomination for the transportation of persons to or from any activity of the religious organization or denomination.
(2) This definition does not include:
(a) A bus operated by a public utility, municipal corporation or common carrier authorized to conduct local or interurban transportation of passengers when such bus is on a regularly scheduled route for the transportation of other fare paying passengers or furnishing charter service for the transportation of groups on special trips or in connection with special events and not over a regular or customary religious organization bus route;
(b) A motor vehicle licensed or required to be licensed as a school bus; or
(c) A motor vehicle designed for carrying not more than nine persons, including the driver, which is not registered as a religious organization bus under 625 ILCS 5/3-808.
RESCUE SQUAD. A voluntary association of individuals or a fire department dedicated to saving lives through the rescue of persons entrapped in wrecked vehicles or other hazardous circumstances and associated with some unit of government.
RESCUE SQUAD VEHICLE. A vehicle specifically designed, configured and equipped for the performance of access and extrication from hazardous or life-endangering situations. Such vehicles may or may not have emergency medical transport capability.
RESIDENCE DISTRICT. The territory contiguous to and including a highway not comprising a business district when the property on such highway for a distance of 300 feet or more is in the main improved with residences or residences and buildings in use for business.
RESIDENT.
(1) Every natural person who resides in this state shall be deemed a resident of this state.
(2) In the case of a firm, copartnership or association, if the principal place of business of such firm, copartnership or association is located in the state, then such firm, copartnership or association shall be deemed a resident of the state.
(3) In the case of a corporation, if the corporation was incorporated under the laws of the state or if the principal place of business of such corporation is in the state, then such corporation shall be deemed a resident of the state.
RETAIL SALE. The act or attempted act of selling vehicles or otherwise disposing of a vehicle to a person for use as a consumer.
REVERSIBLE LANE. A lane of a two or more laned roadway upon which traffic may be directed to move in either direction by means of lane-control signals or other devices, in conjunction with official signs.
REVOCATION OF DRIVER’S LICENSE. The termination by formal action of the Secretary of a person’s license or privilege to operate a motor vehicle on the public highways, which termination shall not be subject to renewal or restoration except that an application for a new license may be presented and acted upon by the Secretary after the expiration of at least one year after the date of revocation.
RIGHT-OF-WAY. The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.
ROAD TRACTOR. Every motor vehicle designed and used for drawing other vehicles and not so constructed as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawn.
ROADWAY. The portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separate roadways, the team ROADWAY as used herein shall refer to any such roadway separately, but not to all such roadways collectively.
RURAL MAIL DELIVERY VEHICLE. Every vehicle used to deliver United States mail on a rural mail delivery route.
SAFETY ZONE. The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone.
SCHOOL BUS.
(1) Every motor vehicle, except as provided in division (2) below, owned or operated by or for any of the following entities for the transportation of persons regularly enrolled in any such entity as students in grade 12 or below in connection with any activity of the entity:
(a) Any public or private primary or secondary school;
(b) Any primary or secondary school operated by a religious institution; or
(c) Any public, private or religious nursery school.
(2) This definition shall not include the following:
(a) A bus operated by a public utility, municipal corporation or common carrier authorized to conduct local or interurban transportation of passengers when such bus is not traveling a specific school bus route but is:
1. On a regularly scheduled route for the transportation of other fare paying passengers;
2. Furnishing charter service for the transportation of groups on field trips or other special trips or in connection with other special events; or
3. Being used for shuttle service between attendance centers or other educational facilities.
(b) A motor vehicle of the First Division; or
(c) A multifunction school-activity bus.
SECRETARY. The Secretary of State of Illinois.
SECRETARY OF STATE. The Secretary of State of Illinois.
SEMI-TRAILER. Every vehicle without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
SIDEWALK. The portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use of pedestrians.
SITUS OR BASE OF VEHICLE. The place where a vehicle is principally garaged, or from whence it is principally dispatched, or where the movements of such vehicle usually originate.
SOLID TIRE. Every tire of rubber or other resilient material which does not depend upon compressed air for the support of the load.
SPECIAL MOBILE EQUIPMENT. Every vehicle not designed or used primarily for the transportation of persons or property and only incidentally operated or moved over a highway, including, but not limited to, ditch digging apparatus, well boring apparatus and road construction and maintenance machinery such as asphalt spreaders, bituminous mixers, bucket loaders, tractors other than truck tractors, ditches, leveling graders, finishing machines, motor graders, road rollers, scarifiers, earth moving carry-alls and scrapers, power shovels and drag lines and self-propelled cranes and earth moving equipment. The term does not include house trailers, dump trucks, truck mounted transit mixers, cranes or shovels, or other vehicles designed for the transportation of persons or property to which machinery has been attached.
SPECIALLY CONSTRUCTED VEHICLE. Every vehicle of a type required to be registered hereunder not originally constructed under a distinctive name, make, model or type by a generally recognized manufacturer of vehicles and not materially altered from its original construction.
SPEED-CHANGE LANE. An auxiliary lane, including tapered areas, primarily for the acceleration or deceleration of vehicles entering or leaving the through traffic lanes.
STAND or STANDING. The halting of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in receiving or discharging passengers.
STINGER-STEERED SEMI-TRAILER. Every semi-trailer which has its kingpin on a projection to the front of the structure of such semi-trailer and is combined with the fifth wheel of the truck tractor at a point not less than two feet to the rear of the center of the rearmost axle of such tractor.
STOP. When required, means complete cessation film movement.
STOP or STOPPING. Any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
STREET. The entire width between boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
STREETCAR. A car other than a railroad train for transporting persons or property and operated upon rails principally within a municipality.
SUBURBAN DISTRICT. The portion of any city, village or incorporated town other than the business and residence districts.
SUSPENSION, OF DRIVER’S LICENSE. The temporary withdrawal by formal action of the Secretary of State of a person’s license or privilege to operate a motor vehicle on the public highways, for a period specifically designated by the Secretary of State.
THROUGH HIGHWAY. Every highway or portion thereof on which vehicular traffic is given preferential right-of-way, and at the entrances to which vehicular traffic from intersecting highways is required by law to yield right-of-way to vehicles on such through highway in obedience to either a stop sign or a yield sign, when such signs are erected as provided in this title.
TOW TRUCK. Every truck designed or altered and equipped for and used to push, tow or draw disabled vehicles by means of a crane, hoist, towbar, towline or auxiliary axle, and to render assistance to disabled vehicles.
TRACKLESS TROLLEY COACH. Every motor vehicle which is propelled by electric power obtained from overhead trolley wires but not operated upon rails.
TRAFFIC. Pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances either singly or together while using any highway for purposes of travel.
TRAFFIC CONTROL SIGNAL. Any official traffic control device, whether manually, electrically mechanically operated, by which traffic is alternately directed to stop and permitted to proceed.
TRAILER. Every vehicle without motive power in operation, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
TRANSPORTER. Every person engaged in the drive-away or tow-away business of transporting vehicles, not his or her own, by driving, either singly or by the towbar, saddle mount or full mount methods or any combinations thereof or by drawing or towing house trailers, semi-trailers or trailers, including their coupling devices, and using the public highways of this state therefor.
TRUCK. Every motor vehicle designed, used or maintained primarily for the transportation of property.
TRUCK TRACTOR. Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn.
TRUCKSTER. Every motor vehicle or motorcycle with three wheels designed, used or maintained primarily for the transportation of property.
URBAN AREA. Any incorporated or unincorporated area developed primarily for residential and/or business purposes.
URBAN DISTRICT. The territory contiguous to and including any street which is built up with structures devoted to business, industry or dwelling houses situated at intervals of less then 100 feet for a distance of a quarter of a mile or more.
USED CAR DEALER. Every person engaged in the business of buying, selling or exchanging used motor vehicles and who has an established place of business for such purpose in this state.
USED MOTOR VEHICLE. Every motor vehicle which has been sold, bargained, exchanged, given away or title transferred from the person who first acquired it from the manufacturer or importer, dealer or agent of the manufacturer or importer and so used as to have become what is commonly known as “second-hand” within the ordinary meaning thereof: provided, that a new motor vehicle shall not be considered as a USED MOTOR VEHICLE until it has been placed in a bona fide consumer use, notwithstanding the number of transfers of such motor vehicle. The term BONA FIDE CONSUMER USE means actual operation by an owner who acquired the vehicle for use in business or for pleasure purposes and who has been granted a certificate of title on such motor vehicle and has registered such motor vehicle, all in accordance with the laws of the residence of the owner.
VEHICLE. Every device, in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power, devices used exclusively upon stationary rails or tracks and snowmobiles as defined in the Snowmobile Registration and Safety Act, being 625 ILCS 40/1-1. For this chapter, VEHICLES are divided into two divisions:
(1) First Division: Those motor vehicles which are designed for the carrying of not more than ten persons.
(2) Second Division: Those motor vehicles which are designed for carrying more than ten persons, those designed or used for living quarters and those vehicles which are designed for pulling or carrying property, freight or cargo, those motor vehicles of the First Division remodeled for use and used as motor vehicles of the Second Division, and those motor vehicles of the First Division used and registered as school buses.
YIELD RIGHT-OF-WAY. When required by an official sign means the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left, but when the roadway is clear may proceed into the intersection.
