A. Superintendent Of Public Works To Supervise: All public streets, alleys, sidewalks and other public ways shall be under the supervision of the Superintendent of Public Works. He shall have the supervision over all work thereon, the cleaning thereof, and shall be charged with the enforcement of all ordinance provisions relating to such public places (except traffic ordinances) and is hereby authorized to enforce such provisions.
B. Datum Plane And Bench Mark: There is hereby established and fixed a base or datum plane in and for the Village for determining, measuring and fixing elevations and grades in the Village, which base or datum plane shall be known under the style and name of "Hampshire Village Datum"; said datum is located at the northwest corner of Route 72 and State Street and is marked by a bronze disc, Illinois 46A.
C. Permits Required: It shall be unlawful to construct or lay any pavement on any public street, alley or other public way or to repair the same, without first having secured a permit therefor. Application for such permits shall be made to the Superintendent of Public Works and shall be filed with the Village Clerk, and shall state the location of the intended pavement or repair, the extent thereof, and the person actually doing the construction work; and shall be accompanied by payment of the fee established in Section 9-7-1 of this Chapter.
D. Performance Bond Required: Each applicant for a permit to construct, repair or lay any pavement on any street, alley, sidewalk or other public way shall file a performance bond, with surety conditioned to indemnify the Village for any loss or damage resulting from the work undertaken or the manner of doing the same, or subject to such other conditions as may be required by the Superintendent or the Board of Trustees. Said bond shall be in an amount not less than one hundred twenty five percent (125%) of the estimate of the Superintendent of Public Works of the cost of the installation of the improvements, to be approved by the Board of Trustees. A. Specifications For Construction: All street and sidewalk pavements shall be in conformity with specifications of the Village.
1. Streets shall conform in all respects to the standards established in Section 7-3-4, Street Improvements; and Chapter 7, Article 4, Design Standards, of this Code; and to such other specifications and design standards from time to time required by the Village Board.
2. Sidewalks shall conform in all respects to the standards established in Section 7-3-6, Sidewalks, of this Village Code.
B. Whenever any sidewalk or portion thereof is replaced, construction shall be in accordance with the provisions of this Article, and the abutting property owner or owners shall be liable upon completion of said work to pay the cost of replacement in addition to any and all permit fees required under the provisions of this Article; provided, however, as follows:
1. Prior to commencing any replacement of sidewalk or any portion thereof, the abutting property owner or owners may present to the Village Manager no fewer than two (2) bids for the cost of the work.
2. The Village Manager shall consider the bids presented and accept or reject them.
3. Upon acceptance of a bid by the Village Manager and approval of the completed work by the Superintendent of Public Works, the Village shall reimburse said abutting property owner for one-half (1/2) of the bid cost.
C. Sidewalk Ramps For The Handicapped: Where sidewalks are constructed or replaced at street intersections and other crosswalks adjacent to barrier, mountable or roll type curb, a sidewalk ramp for the handicapped shall be provided in accordance with the requirements outlined in the "Highway Standards", state of Illinois, department of public works and buildings, division of highways, bureau of design.
D. Barricades Required:
1. Any person laying or repairing any pavement on any street, sidewalk or other public place, or making any excavation in any such place, shall maintain suitable barricades to prevent injury to any person or vehicle by reason of the work. Such barricades shall be protected by appropriate lights during periods of darkness.
2. Defects in pavements shall be barricaded to prevent injury. Any person properly maintaining an opening or excavation in such place shall guard such opening or excavation while the same remains open, by proper barricades and lights.
3. It shall be unlawful to remove, disturb or interfere with a barricade or light lawfully placed to protect new pavements, excavations or openings in any public street, alley or sidewalk. (1985 Code; amd. Ord. 22-21, 9-15-2022; Ord. 22-26, 10-6-2022)
A. Injury To Pavements:
1. It shall be unlawful to walk or drive any vehicle or animal upon, or injure any newly laid street or sidewalk pavement while the same is guarded by a warning sign or barricade, or knowingly to injure any soft or newly laid pavement.
2. It shall be unlawful for any person to damage any existing sidewalk, street or alley pavement.
B. Obstructions Or Defects: It shall be unlawful for any person to cause, create or maintain any obstruction of any street, alley, sidewalk or other public way, except as may be specifically authorized by the Board of Trustees. Notwithstanding the foregoing, outdoor seating is allowed in accordance with the provisions of Article XIII, Chapter 4 of this code.
C. Private Use For Display Or Advertising: It shall be unlawful for any person to use a street, sidewalk or other public place as space for the display or sale of goods or merchandise, or for peddling merchandise; or to write or mark any signs or advertisements on such place, except as may be specifically authorized by the board of trustees.
D. Deposits, Deliveries On Sidewalks:
1. It shall be unlawful for any person to deposit, or to permit to be deposited, upon any public way in the village, including any public street or sidewalk, any rubbish, trash, or debris; any mud, dirt, cement, concrete, gravel, stones, plant matter, including grass clippings; any snow from snow removal operations; or any material which may cause damage to said sidewalk or street, which may be a hazard to persons, animals, property or vehicular traffic, or which may impede the flow of storm water.
2. Any person who shall clear or remove any snow, ice, or other precipitation from any sidewalk, private drive, driveway or parking lot, on or adjacent to his or her property shall clear or remove same to a location on his or her property only, and shall not clear or remove same to any public property. Provided, in the event that there shall be an excessive amount of snow, ice, or other precipitation, such that there is no location on the person's property to place the snow, ice, or other precipitation cleared or removed from any sidewalk, private drive, driveway, or parking lot, then such snow, ice, or other precipitation may be placed on the public parkway along an existing curb line or shoulder within the right of way, but in no event shall any such snow, ice, or other precipitation be placed on the paved area of the right of way. Provided, further, as to any property located in the central business district in the village, the provisions of this subsection D2 regarding sidewalks shall not apply, but the provisions as to private drives, driveways, or parking lots shall apply and be in full force and effect.
3. Merchandise or other articles may be deposited for not more than one-half (1/2) hour on a sidewalk, if preparatory to delivery; provided, the usable width of the sidewalk shall not thereby be reduced to less than four feet (4').
4. In no event shall any person at any time cover or block access to any fire hydrant in the village.
5. In the event any person depositing any material on a sidewalk in violation of this section fails or refuses to immediately remove it, the superintendent of public works may cause the material to be removed. The cost incurred by the village for such removal and all expenses incurred in connection therewith shall be assessed against the property and/or the person who deposited the material. Assessment of such costs against the person who violated the provisions of this section shall not be construed as a waiver of the right of the village to file a complaint against such person and/or to request that a fine be imposed upon conviction, in accordance with section 9-6-1 of this chapter.
E. Openings Or Stairways: It shall be unlawful to construct or maintain any opening or stairway in any public street, sidewalk or alley without a permit from the village. All such lawfully maintained openings shall be guarded by a suitable, strong cover or a railing, to be approved by the superintendent of public works. No such opening shall be maintained unless there is deposited or filed with the village clerk a certificate of insurance issued by a liability insurance company authorized to do business in the state naming the village as an additional insured and providing liability insurance for personal injury and property damage with limit coverage of not less than three hundred thousand dollars ($300,000.00) per person and one million dollars ($1,000,000.00) per occurrence for personal injuries and one hundred thousand dollars ($100,000.00) for property damage.
F. Poles And Wires: It shall be unlawful to erect or maintain any poles or wires on or over any public street, alley or other public way without having first secured permission from the village.
G. Burning Prohibited: It shall be unlawful for any person to burn any leaves, paper or rubbish or any other substance upon any of the paved areas of public streets, sidewalks or alleys within the village.
H. Drains: It shall be unlawful to obstruct any drain in any public street or alley.
J. View At Corners: It shall be unlawful to construct or maintain, or permit to remain, any fence or other structure, or any bushes or other plants or weeds, on a corner lot within fifty feet (50') of the street line which obstructs the view at a height of more than three feet (3') above the level of the adjacent street pavement.
K. Gas Pumps: It shall be unlawful to erect or maintain any gasoline or other pump or tank in any public right of way, street, alley or sidewalk anywhere in the village. (1985 Code; amd. Ord. 07-25, 5-3-2007; Ord. 09-21, 6-18-2009; Ord. 23-06, 5-4-2023)
