5-3-4: VEHICLE WEIGHT LIMIT; AXLE LIMIT; SPECIAL PERMITS:
   A.   Weight Limitation: It shall be unlawful to operate any vehicle on any street in the village when the gross weight of such vehicle exceeds five (5) tons (10,000 pounds) per axle, except that the police chief or his designee may authorize a temporary permit for the purpose of making a delivery or picking up a load in the village, when in his judgment the loads are of a nondivisible nature and delivery by other means is not practical.
   B.   Axle Limitations: No person shall operate a motor vehicle upon any street in the village when such vehicle has more than two (2) axles, except for the purpose of making a delivery or picking up a load in the village. The police chief or his designee may waive this axle limitation when an emergency exists or other good cause is shown that observance of this limitation would be impractical.
   C.   Application For Special Permit; Special Permit Fee:
      1.   Any person desiring to obtain a special permit authorizing the applicant to operate or move a vehicle or combination of vehicles with weight of vehicle or load exceeding the maximum limitations set forth in this section on any street in the village shall submit an application to the police department on forms prescribed by the police chief. The application for any such permit shall specifically describe and identify the vehicle or vehicles and loads to be operated or moved and the particular streets for which permit to operate is requested, and whether such permit is requested for a single trip or for continuous operation, and include the date(s) and hours authorized.
      2.   If the police chief or his designee determine that the loads are of a nondivisible nature and delivery by other means is not practical, they may issue a special permit in writing authorizing the applicant to operate or move a vehicle or combination of vehicles as described in the application, and with such further conditions or limitations as they deem necessary to protect the public health, safety and welfare, including limiting or prescribing conditions of operation of such vehicle or vehicles, when necessary to assure against undue damage to the road foundations, surfaces or structures, or requiring that the vehicle not be driven on the streets for more than the minimum distance necessary for such purpose, and the permit may require such undertaking, cash deposit, bond or other security as may be deemed necessary to compensate for any injury to any roadway or road surface.
      3.   The village shall collect a fee as shown in the annual fee schedule from applicants for the issuance of a special permit to operate or move a vehicle with weight of vehicle or load exceeding the maximum limitations set forth in this section.
   D.   Signs Posted: Signs posting the weight limitation of five (5) tons (10,000 pounds) shall be located at the entrance to the village so as to be visible to northbound traffic on Overlook Drive near Golf Road and to eastbound traffic on Overlook Drive near the right of way of the METRA railroad.
   E.   Penalty: Any person violating this section shall, on conviction thereof, be subject to a class D penalty as provided in section 1-4-1 of this code. (Ord. 2009-04, 9-14-2009)
