(A) All newly hired, transferred or promoted employees will be required to successfully complete a minimum one year probationary period. During this probationary period, an employee's performance may be appraised periodically by the employees' supervisor(s).
(B) An employee being hired as a Police Officer, who must complete the Basic Training Program through the Department of Criminal Justice, will begin his or her one year probationary period at the time the employee is discharged from that basic training. That period is not to exceed 12 months from the original date of hire, not including any time the officer was employed and completing the basic training required by KRS 15.404.
(C) The initial probationary period of any employee may be extended. In such case, prior to or upon the expiration of the existing probationary period, the employee will receive notification of the reasons and length of the extended probationary period. During and following all probationary periods, the city may terminate employment at-will.

FIRE AND EMERGENCY MEDICAL SERVICES DEPARTMENT
There is hereby created the City of Florence Fire and Emergency Medical Services Department (hereinafter called the Department), which shall have the duty of providing fire protection services, rescue services, hazardous material incident mitigation services and emergency medical services to the city and to such areas as the city may contract or bill to serve.

The City of Florence Fire Department and City of Florence Rescue Squad, being merged into the Department by this subchapter, shall cease to exist and all paid and volunteer members and employees of the Florence Fire Department and Florence Rescue Squad are hereby assigned to the Department in accordance with the amendments to the personnel policies and procedures set out in Chapter 34.

The city's Fire and Emergency Medical Services Department Rules and Regulations, which are attached to Ordinance 0-21-93 as Exhibit "B" and are on file with the City Clerk, are hereby adopted, approved and incorporated herein by reference. Said rules and regulations, together with all policies and procedures adopted in accordance with said rules and regulations, shall govern the operations of the Department and conduct of the members and employees of the Department.

(A) Pursuant to KRS 83A.087, the two persons holding the positions of Assistant Chief-Fire Division are hereby designated as citation officers and are authorized to issue citations upon observation of violations of applicable laws, codes and regulations related to fire prevention and fire safety. The qualifications of the Assistant Chief-Fire Division shall be as set out in the Personnel Policies and Procedures, as amended, which is set forth in Chapter 34.
(B) The citation officers designated herein shall not have the powers of a peace officer to make arrested or carry deadly weapons.
(C) The procedure for citations issued by the citation officers designated herein shall be as provided in KRS 431.015.

(A) Reimbursement Program. That a Volunteer Member Reimbursement Program to reiimburse volunteer members of the Fire/EMS Department for expenses resulting from their participation in the programs of the Department through the payment of a nominal fee is hereby established as hereinafter set out.
(B) Definitions. For the purposes of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning:
“FULL SHIFT.” A specific 12 hour time period, usually 6:00 p.m. to 6:00 a.m., in which a member is serving on a scheduled shift at a fire station.
“HALF SHIFT.” A specific six hour time period, usually between 6:00 p.m. and 12:00 a.m. or 12:00 a.m. until 6:00 a.m., in which a member is serving on a scheduled shift at a fire station.
“OFF DUTY-ON CALL.” A member who is immediately available for response from his or her residence or a location that is within one mile from the city and/or fire district limits.
“ON DUTY-IN STATION.” A member who is in station and serving on a scheduled shift, either partial, half or full.
“PARTIAL SHIFT.” A specific time slot other than six or 12 hours in which a member is serving on a scheduled shift at a fire station.
(C) Eligibility.
(1) Members with the title of "volunteer firefighter" must complete all required training and participation requirements, on a yearly basis, to be eligible for reimbursement.
(2) New members with the title of "recruit-volunteer firefighter" who possess little or no firefighting experience, are not eligible to receive reimbursement until they have completed all required training and a department orientation. Final eligibility for reimbursement of these members shall be at the discretion of the Fire/EMS Chief.
(D) Reimbursement rates. Volunteer members shall be reimbursed at the following rates:
(1) Members who are considered "off duty-on call" shall be reimbursed at the rate of $10 per call answered. This rate applies to all positions and all ranks.
(2) Members who are considered "on duty-in station" shall be reimbursed $18 for half shift, $36 for full shift or a proportional amount for a partial shift. No additional reimbursement is paid out for run response by a member while he or she is on duty in station. This rate applies to all positions and all ranks.
(E) Run hours.
(1) Each member must run a minimum of 24 hours "on duty-in station" in each calendar month, unless excused by the Fire/EMS Chief.
(2) Each member shall be limited to run a maximum of 180 hours "on duty-in station" in each calendar month. Any member who violates this policy and runs additional hours beyond 180 will receive no reimbursement for those hours above 180.
(3) Each member shall be permitted to run a maximum of 48 consecutive hours of "on duty-in station" duty after which they must take a minimum of 12 hours off.
(4) There is no limit on the number of "off duty-on call" runs a member may respond to.
(F) Off duty-on call volunteers answering calls:
(1) When an off-duty member responds to a run, he or she shall receive $10 per run provided that said member responds immediately and arrives at the station within ten minutes of the dispatch of the incident. Members who arrive late, or after an incident has been terminated, shall not be reimbursed. Exceptions to the "ten minute rule" include the following:
(a) During a long incident, a member who arrives at the station after the initial ten minutes and remains on standby, assists with relief at the scene as directed, and/or assists with clean up activities after companies return to the station shall be reimbursed for the run.
(b) In the event a run is dispatched, and is quickly canceled prior to any company responding from that station, off duty members who are enroute to the station shall terminate their response. No reimbursement shall be paid. If the first company has left the station, but is quickly canceled, personnel enroute to the station may continue on a non-emergency basis and sign the Incident Response Roster. These members will be reimbursed for the run. Members who do this are required to remain at the station until the company returns to quarters.
(2) In the event that multiple runs dispatched within one hour (i.e. as a result of storms, and the like), each responding off duty member will be reimbursed $10 for the initial response. After one hour in service, these members shall be reimbursed at the "on duty-in station" rate. All responding, off duty members shall be reimbursed for responding to an incident, whether they responded on the apparatus or stood by at the station. Responding members who arrive at the station after the dispatched company(s) have left must remain on standby at the station until all companies from that station have returned to quarters and/or all members have been excused by Battalion Commander.
(G) Written policy. The Chief of the Fire/ EMS Department shall promulgate and implement a written policy establishing guidelines and procedures for the administration and operation of the reimbursement program established in this section.

(A) Training and qualifications. That persons hired for service with the Fire/EMS Department must have the following qualifications and meet the following training requirements within the time specified:
(1) Firefighter/EMT or Firefighter/Paramedic:
(a) Shall meet job requirements for the rank of firefighter as set down by the City of Florence "Job Descriptions" within City Personnel Policies; and must within one year of employment:
1. Attain certification as a Kentucky 400 hour Certified Career Firefighter.
2. Complete federal incident management courses: IS-100, 200 and 700.
3. Become certified as a Kentucky Company Level Fire Inspector.
(b) Must within two years of employment attain Firefighter I, Firefighter II and Hazardous Materials Awareness and Operations accreditation through one of the following curricula:
1. ProBoard Accredited Course.
2. IFSAC Accredited Course.
(2) Other positions filled from outside the department. If the city chooses to fill open positions for the ranks of Battalion Chief-Fire Marshal, Battalion Chief-Training Officer, Captain-EMS Coordinator, Assistant Fire/EMS Chief and/or Fire/EMS Chief from outside of its Fire/EMS Department, the individual hired to any of these positions must:
(a) Within one year of appointment, obtain and thereafter maintain certification as a Kentucky 400-hour Career Level Firefighter, and a minimum EMS certification of Kentucky Emergency Medical Technician-Basic.
(b) Within two years of appointment, obtain and thereafter maintain certification as a Fire Instructor I through one of the following curricula:
1. Kentucky Fire Instructor I (pre-IFSAC).
2. ProBoard Accredited Course with Kentucky Instructor Number.
3. IFSAC Accredited Course with Kentucky Instructor Number.
(c) Within two years of appointment, obtain and thereafter maintain certification and as a Kentucky Company Level Fire Inspector.
(d) Within three years of appointment, obtain and thereafter maintain all requirements of all ranks of the department credentialing system with the exception of; Firefighter I, Firefighter II, IFSAC Driver Operator, IFSAC Aerial Operator and Fire Officer I.
(B) Promotional requirements. In order to be eligible for promotion to ranks above firefighter, personnel must attain the following required training and/or certifications for each of the following ranks:
(1) For the rank of Fire/EMS Lieutenant:
(a) Must meet all job requirements for promotion to the rank of Fire/EMS Lieutenant as set down by the City of Florence “Job Descriptions” within City Personnel Policies.
(b) Must have served a minimum of two (2) years within the rank of Firefighter/EMT or Firefighter/Paramedic within the Florence Fire/EMS Department.
(c) Must be certified to operate all department apparatus based on departmental requirements and curricula.
(d) Must possess certification as a Fire Service Instructor through one of the following curricula:
1. Kentucky Fire Instructor I (pre-IFSAC).
2. ProBoard Accredited Course with Kentucky Instructor Number.
3. IFSAC Accredited Course with Kentucky Instructor Number.
(e) Must have completed an Incident Safety Officer course through one of the following curricula:
1. ProBoard Accredited Course.
2. IFSAC Accredited Course.
3. National Fire Academy Course.
4. FDSOA Accredited Course.
(2) For the rank of Fire/EMS Captain:
(a) Must meet all job requirements for promotion to the rank of Fire/EMS Captain as set down by the City of Florence “Job Descriptions” within City Personnel Policies.
(b) Must possess Fire Officer I accreditation, through one of the following curricula:
1. Northern Kentucky Fire Officer Development Course.
2. ProBoard Accredited Course.
3. IFSAC Accredited Course.
(c) Must have completed federal incident management courses: IS-300, 400 and 800.
(3) For the rank of Fire/EMS Battalion Chief:
(a) Must meet all job requirements for promotion to the rank of Fire/EMS Battalion Chief as set down by the City of Florence “Job Descriptions” within City Personnel Policies.
(b) Must have served a minimum of one (1) year within the rank of Fire/EMS Captain.
(c) Must have completed the following NFA coursework:
1. Command and Control of Incident Operations.
2. Command and Control of Target Hazards.
(4) For the rank of Fire/EMS Assistant Chief:
(a) Must meet all job requirements for promotion to the rank of Fire/EMS Assistant Chief as set down by the City of Florence “Job Descriptions” within City Personnel Policies.
(b) Must have served a minimum of one (1) year within the rank of Fire/EMS Battalion Chief.
(5) For the rank of Fire/EMS Chief:
(a) Must meet all job requirements for promotion to the rank of Fire/EMS Chief as set down by the City of Florence “Job Descriptions” within City Personnel Policies.
(b) Must have served a minimum of one (1) year within the rank of Fire/EMS Assistant Chief or a minimum of one (1) year within the rank of Fire/EMS Commander.
(C) Good faith exception. Staff members may be granted a temporary exemption from promotional requirements related to the National Fire Academy (NFA) when, through no fault of their own, they had applied for and did not receive admittance to a NFA course. A staff member denied admittance to a NFA course must re-enroll for the required class as soon as possible, but no more than one year from the date of the promotional requirement.
(D) Severability. If any section, paragraph, clause, provision or phrase of this section is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, provisions or phrases of this section, or this section as an entirety, it being the legislative intent that this section shall be valid notwithstanding the invalidity of any section, sentence, clause, provision or phrase.
