(a) No person shall engage or attempt to engage in solicitation in the following manners:
(1) By approaching or speaking to a person, or following a person before, during or after soliciting if that conduct is intended or is likely to cause a reasonable person to fear bodily harm to oneself or another, or damage to or loss of property, or otherwise be intimidated into giving money or other object of value.
(2) By knowingly touching or grabbing another person or that person’s property without that person’s consent.
(3) By knowingly following another person and continuing to engage or attempt to engage in distribution with that person after that person has made affirmative communication that the person is unwilling or unable to engage in distribution.
(4) Intentionally blocking or interfering with the safe or free passage of a pedestrian or vehicle by any means, including unreasonably causing a pedestrian or vehicle operator to take evasive action to avoid physical contact in the course of soliciting.
(5) On private property without the permission from the owner or other person lawfully in possession of such property.
(6) For purposes of this section, the term "solicitor" means using the spoken, written or printed work, or bodily gestures, signs or other means with the purpose of obtaining immediate donation of money or other thing of value.
(7) Whoever violates this section is guilty of aggressive solicitation, a misdemeanor of the fourth degree. The penalty shall be as provided in Section 599.02.
(8) This section does not apply to those persons who have obtained a license to peddle or solicit as provided in Euclid Codified Ordinances Chapter 757.
(b) No person shall knowingly approach within 20 feet of any person who is actively using an automated teller machine without that person’s consent.
(1) "Automated teller machine" means a fixed device linked to a financial institution’s account records which is able to carry out transactions, including but not limited to, account transfers, deposits, withdrawals, balance inquiries, and mortgage and loan payments.
(2) Whoever violates this section is guilty of ATM privacy, a misdemeanor of the fourth degree. The penalty shall be as provided in Section 599.02.
