1761.01 RENTALS; CERTIFICATE REQUIRED.
   On and after January 1, 1989, it shall be unlawful for the owner, agent or person in charge of any dwelling structure used, designed or intended to be used as a multiple dwelling or a single, two- or three-family dwelling structure, or a short term rental to rent or lease such structure or any part thereof for residential occupancy, unless the owner thereof holds a Rental License issued by the Code Official for such structure, which License has not expired, been revoked or otherwise become null and void, or unless such structure or part thereof is licensed as a temporary rooming house.
   For purposes of this Chapter 1761, a short-term rental shall be defined as any dwelling unit that is rented wholly or partly for a fee for less than thirty (30) consecutive days be persons other than the permanent occupant or owner from which the permanent occupant or owner receives monetary compensation.

1761.02 APPLICATION; ISSUANCE.
   (a)   (1)   An application for a Rental License required by the provisions of this Code for all multifamily units with three or more dwelling units and commercial buildings with residential tenant space shall be made annually to the Housing Department not later than January 31 of each year, in writing, by supplying the information and date to determine compliance with applicable laws, ordinances, rules and regulations for the existing use or occupancy or the intended use or occupancy. Such application shall be made on forms supplied by the Code Official and shall be accompanied by the fee required by the provisions of this Code.
      (2)   The Code Official may require the submission of an affidavit stating such information, and he or she may cause a general inspection of the structure or premises to be made.
      (3)   Applications for a Rental License for all single-family, two-family, three family, condominium units and short term rentals shall be made every year in accordance with the provisions of this section.
   (b)   If it is found that a building or other structure is in compliance with the provisions of this Code and all other laws, ordinances, rules and regulations applicable thereto, the Code Official shall issue a Rental License for such building or structure which shall contain the following information:
      (1)   The street address or other identifying characteristics of the building or other structure;
      (2)   The name and address of the owner/corporation. If the owner/corporation does not reside in or have a principal place of business in Ohio, the owner/corporation shall provide a name, address, phone number and email of a manger/agent in charge of the building or structure who does reside in or have a principal place of business in Ohio;
      (3)   The exact nature and extent of the use or occupancy authorized;
      (4)   The period for which such Rental License is issued;
      (5)   Other information deemed pertinent by the Code Official for the purposes of this section.
   (c)   Upon written request to the trustees or officers of any condominium association, said association shall provide a list of those condominium units in the association that are being rented from or otherwise not occupied by their current legal owner, The association shall additionally provide a name and current address of the owner(s) and occupant(s) of all said condominium units.
   (d)   An owner must register any multiple dwelling or residential rental unit which is not owner-occupied with the Department of Housing within thirty days after obtaining legal possession of the property.

1761.03 NEW OR REMODELED BUILDINGS. (REPEALED)

1761.05 RENTAL LICENSE FEES.
   (a)   Rental License. An application for a Rental License shall be made on the forms provided by the Housing Department. Original applications are due before the property is occupied by a tenant as required below. The Code Official shall schedule a time to complete a code compliance inspection of the property. The applicant is entitled to one initial inspection and one follow-up compliance inspection for each new or rental application.
   (b)   New and Renewal Applications and Fees.
      (1)   Rental Licenses (new and renewal) are in effect for one (1) year after date of issuance.
      (2)   Buildings with more than three (3) units. New and renewal applications and fees are due on or before January 31 of each year except for an original application as a rental property which are due at least thirty (30) days prior to operating any unit as a rental. Application fee shall be Two Hundred dollars ($200.00) plus thirty-five dollars ($35.00) per unit. Fees will be prorated for an original application issued after January 31.
      (3)   Single-family dwellings, two-family dwellings and three family dwellings and individual condominium dwelling units. Applications and fees are due at least thirty (30) days prior to operating any dwelling unit in a single-family dwelling, two-family dwelling or three family dwelling as a rental property. Renewal applications and fees are due at least fifteen (15) days prior to the end of the current rental license. Application fee shall be Two Hundred dollars ($200.00) per dwelling. Fees will be prorated for an original application issued after January 31.
      (4)   Short-term rental units. For every dwelling unit operated as a short-term rental during any part of a year, an application and fees are due at least thirty (30) days prior to initial rental. Renewal applications and fees are due at least fifteen (15) days prior to the end of the current rental license. Application fee shall be Two Hundred dollars ($200.00) per unit. Fees will be prorated for an original application issued after January 31.
   (c)   WebCheck credit. The owner or manager shall be provided one credit of thirty-two dollars ($32.00) per unit, per year, against the annual rental inspection fees of condominium units and one to three family rental properties if the owner or manager provides verification to the Housing Department that they obtained a WebCheck background check of their tenant(s) through the City of Euclid Police Department or an approved Ohio Attorney Generals Office's Bureau of Criminal Identification and Investigation WebCheck vendor.
   (d)   Late fees and penalties.
      (1)   Failure to file a timely application and fee under division (b) of this section shall result in a late filing fee assessed as set forth below in addition to the required fees in division (b):
         A.   Buildings with three or more units. A nonrefundable fee of 10% of original invoice but not less than two hundred dollars ($200.00).
         B.   Single, two family homes and short term rentals. A nonrefundable fee of two hundred dollars ($200.00).
         C.   Re-inspection or lock out. Failure to meet with the Code Official or allow the Code Official access to the structure or any room, unit or secured portion of a structure at the scheduled inspection time shall result in a re-inspection fee of fifty dollars ($50.00) per additional inspection. The fee shall be paid in full prior to the issuance of a Rental License.
