The owner, as defined in this Code, shall be responsible for compliance with all of the provisions of this Code, except where the responsibility therefor is specifically placed upon a person who is not the owner pursuant to the following, but in no event can responsibility be placed upon a person who is not the owner when any provision of this Code becomes applicable as a result of conversion to condominiums of an existing multi-family dwelling unit, nor can responsibility be placed upon a person who is not the owner in the case of the first sale of any condominium unit resulting from any such conversion.
(a) The placement of responsibility upon a person who is not the owner shall be done only by the signing of an affidavit of assumption with the violations attached to the affidavit and marked Exhibit “A” and prepared by and approved by the Code Official.

(a) The Code Official and representatives of the Code Official are hereby authorized to make or cause to be made inspections of all structures or premises on the parcel to determine whether such structures or premises conform to the provisions of this Code.
(b) Except in emergency situations, if the owner, agent or administrator acting for the owner of a structure or premises refuses entrance to the Code Official or his or her authorized agent and/or inspector for purposes of inspection, no such entrance or inspection shall be made unless a search warrant is properly obtained from a judge of a court of competent jurisdiction. No penalty under the penalty provisions of this Building and Housing Code shall apply against such owner who refuses entrance until such search warrant is obtained.

The Code Official and his or her authorized agents and inspectors shall be supplied with official identification and shall show such identification, upon request, when entering any dwelling structure or premises.
