761.01 DEFINITIONS.
   As used in this chapter:
   (a)   “Public dance” and “public ball” mean any dance or ball to which admission can be had by payment of a fee or by the purchase, possession or presentation of a ticket or token or to which the public generally may gain admission with or without the payment of a fee.
   (b)   “Public dance hall” means any room, place or space which is primarily intended and used for, and which is licensed for the purpose of, holding a public dance or public ball, except, however, that the term “public dance hall” shall not apply to school buildings, churches, club rooms of fraternal, civic or social organizations, and organizations of veterans of the United States Army, Navy or Marine Corps. Any room, place or space which is licensed by the Department of Liquor Control of the State and which is used or primarily intended for the sale of liquor either at wholesale or retail shall not qualify as a public dance hall, even though a dance floor might be a part of the physical make-up of the premises.
   (c)   “Dance school” means any place, room or space in which classes in dancing are held and a fee for instruction is charged.

761.02 DANCE HALL AND DANCE SCHOOL LICENSES AND FEES; LICENSE DISPLAY.
   (a)   No person shall hold any public dance or public ball or hold classes in dancing or give instructions in dancing for hire in any hall or school, school buildings excepted, within the limits of the City, until the dance hall or dance school has first been licensed for such purpose. Licenses shall be issued by the Mayor and the fee therefor shall be paid at the time of the issuing of the license, as follows:
      (1)   For all dance halls having a floor space of not more than 5,000 square feet, the annual license fee shall be fifty dollars ($50.00) per year.
      (2)   If the dance hall has a floor space exceeding 5,000 square feet, the annual license fee shall be one hundred dollars ($100.00) per year.

   (b)   The above fees shall be payable as follows:
      (1)   If the application is received between July 15 and October 15, the full fee;
      (2)   If the application is received between October 15 and January 15, three-fourths of the fee;
      (3)   If the application is received between January 15 and April 15, one-half of the fee;
      (4)   If the application is received between April 15 and July 15, one-fourth of the fee.
   (c)   In computing floor space only that portion of the floor actually used for dancing shall be considered. Each license granted hereunder shall expire on July 15 of each year. Every public dance hall and dance school shall post its license in a conspicuous place within the hall where the dance is held.

761.03 DANCE SCHOOL LICENSE AND FEE.
   The fee for a license for a school in which classes in dancing are held and instruction in dancing is given shall be twenty-five dollars ($25.00) per year and such fee shall not be apportioned.
761.04 DANCE HALL AND DANCE SCHOOL REQUIREMENTS.
   No license for any public dance hall or dance school shall be issued until it is found that the hall or school complies with and conforms to all ordinances, health and fire regulations of the City, and that it is properly ventilated and supplied with sufficient toilet conveniences according to the standards established in the Ohio Revised Code.

761.05 REVOCATION OF LICENSE.
   The license of any public dance hall or dance school may be forfeited or revoked by the Mayor for disorderly or immoral conduct on the premises, or for violation of any of the rules, regulations, ordinances and laws governing or applying to public dance halls, public dances or dance schools. If at any time the license of a public dance hall or dance school is forfeited or revoked, at least six months shall elapse before another license or permit shall be given for dancing on the same premises.
