715.01 LICENSE REQUIRED; APPLICATION.
   No person shall engage in the business of selling Christmas trees out-of-doors within the corporate limits of the City, except as provided in this chapter.
   Every vendor of Christmas trees in the City shall obtain a license to engage in such business. Application for such license shall be made to the Chief of Police, who shall forward the application with his or her recommendation to the Mayor for issuance of such license.

715.02 FEES.
   Fees for nontransferable licenses issued pursuant to this chapter shall be collected as follows:
   (a)   For persons established in the City in the business of a nursery or of tree selling, on an annual basis, at a permanent location, the fee shall be twenty-five dollars ($25.00).
   (b)   Persons in any permanent business other than as designated in subsection (a) hereof, and persons who have resided in the City for a period of one year, may obtain a license at a fixed location for a period of three weeks for a fee of one hundred dollars ($100.00).
   (c)   For itinerant persons or merchants at locations in the City which are temporary the fee shall be five hundred dollars ($500.00).
715.03 RESTRICTIONS ON SALES.
   No person shall conduct the business of Christmas tree selling in an area or use district which is zoned for residential uses. No sale of Christmas trees shall be made from a truck driven house-to-house.

715.04 EXCEPTIONS.
   No license for the sale of Christmas trees shall be required of a church or of a religious organization associated or connected with a church or bona fide charitable service or veterans organization. Such sales may be conducted on the property of the church or bona fide charitable service or veterans organization without a license.

715.99 PENALTY.
   Whoever violates any of the provisions of this chapter is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
