(A) No person, firm or corporation shall sell, dispose of, offer for sale, or cause or permit to be sold, disposed of or offered for sale in the city, at public auction, any gold, silver or plated ware, precious and semiprecious stones, watches or jewelry, whether the property is their own, or whether they are acting as the agents or employees of others, unless the person, firm or corporation desiring to hold a public auction files with the controller of the city, a sworn application stating the name of the owner of the stock, the location by street and street number of the stock and the location where the auction is to be held.
(B) The application shall also specify that the person, firm, or corporation on whose behalf the application is made, shall not have held or conducted an auction sale of similar merchandise within 1 year of the date of the application, and that the person, firm or corporation has been in the same mercantile business at the stated street and street number in the city for at least 1 year prior to the date of the application.
