9-1-3: ADOPTED CODES ON FILE:
Two (2) copies of the model construction codes adopted by the city are on file in the office of the city clerk-treasurer. (2013 Code)
9-1-4: CODES IN EFFECT:
From the date on which this chapter shall take effect, the provisions of said codes, as herein modified, shall be controlling in those areas set forth hereinabove, within the corporate limits of the city. (2013 Code)
9-1-5: CONFLICTS WITH CITY CODE:
Whenever any provision of any of those model construction codes adopted by this chapter conflict with this code, the latter provisions shall govern. (2013 Code)
9-1-6: BUILDING INSPECTOR; ENFORCEMENT:
Any certified city official, employee, or independent contractor designated by the city council, shall be responsible for enforcing the model construction codes adopted by this chapter. Said persons may bear such titles as "building inspector", "plumbing inspector", "electrical inspector", etc., as may be deemed appropriate to indicate their respective areas of concern.
All building review, management, and inspection services within the City limits of the City of Elgin will be subject to review and inspection fees (Building Inspection Fee Schedule), including residential building plan review and inspections, commercial construction plan review and inspections, alteration plan review and inspections, new construction and additions plan review and inspections, accessibility plan review and inspections, fire code review and inspections, planning and zoning services, management, and inspections, and fast track plan review services.
City personnel, subject to direction as the City Council may give by motion or resolution, may establish, reduce or increase the building inspection fee schedule. (2013 Code; amd. Ord. 22-07, 4-12-2022)
9-1-7: NONLIABILITY OF CITY OFFICERS AND EMPLOYEES:
   A.   Relief From Personal Liability: Any officer or employee of the city charged with the enforcement of this chapter and acting in good faith and without malice, for the city, in the discharge of his duties, shall not thereby render himself liable personally and he is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act or omission required or permitted in the discharge of such duties.
   B.   Defense Of Suits: Any suit brought against any officer or employee because of such act or omission performed by him in the enforcement of any provisions of such codes may be defended by the city attorney until the final termination of the proceedings. (2013 Code)
9-1-8: PENALTY:
Any person, firm or corporation who shall fail to do anything required by this title or by any code adopted by this title, who shall otherwise violate any provision of this title or of any code adopted by this title, or who shall violate any lawful regulation or order made by any of the officers provided for in this title, shall be guilty of an offense and, upon conviction thereof, shall be fined in any sum not to exceed the limits established in section 1-4-2 of this code. Each day upon which a violation continues shall be deemed a separate offense. (2013 Code)
