A. Appointment: There is hereby created a cemetery board consisting of five (5) members, to be appointed by the mayor, subject to confirmation by the city council.
B. Adopt Rules And Regulations: The cemetery board shall adopt rules and regulations for its operation which shall be subject to approval by the city council. (1991 Code § 1-47)
A. Council Authority: The city council shall have the sole authority and responsibility for the management of the municipal cemetery tracts, including the right to correct any errors which may occur. (1991 Code § 16-100; amd. 2013 Code)
B. Recording Plats With County: Plats of the cemetery tracts and property dedications shall be recorded in the office of the Comanche County clerk. (1991 Code § 16-100)
C. Lot Sizes, Costs: Each lot shall be divided into sixteen (16) burial lots; each lot shall be designated in the following manner: A-1, A-2, A-3, A-4, B-1, B-2, B-3, B-4, C-1, C-2, C-3, C-4, D-1, D-2, D-3 and D-4. Each lot shall be impartially priced at one hundred twenty five dollars ($125.00) for lots measuring four feet by nine feet (4' x 9'); and two hundred dollars ($200.00) for lots measuring five feet by thirteen feet (5' x 13'); and any person may purchase as many lots as they may desire. D. Lot Sales Subject To Rules And Regulations: All lot sales shall be subject to these and subsequent rules and regulations adopted by the city council.
E. Transfer Of Lots: Ownership of lots shall be nontransferable, except by written permission of the city. (1991 Code § 16-100; amd. 2013 Code)
A. Creation And Use Of Fund: Consistent with state law 1 , the following provisions are hereby established governing the creation and use of the municipal cemetery capital improvements fund:
1. All monies received from donations for the municipal cemetery shall be segregated and set aside as a permanent, nonfiscal, municipal fund to be known as the "cemetery capital improvements fund". The fund shall be placed in an insured, interest bearing account.
2. The cemetery capital improvements fund shall be expended in making capital improvements to cemetery and cemetery related facilities, when necessary, under the direction of the city council.
3. No funds may be appropriated or expended from the cemetery capital improvement fund until claims duly verified by affidavit are presented to, and approved by, the city council, and a recorded vote taken thereon.
B. Additional Guidelines: Consistent with the provisions of this section and said 11 Oklahoma Statutes sections 17-109 and 17-110, the city council may also, by motion, resolution or ordinance, enact additional guidelines or requirements governing the operation of this fund.
C. Use Of Interest Only: The city council hereby directs that only the interest from said fund be used in making expenditures for cemetery facilities of the city. The principal amount shall remain unused in order to develop the capacity for the fund to become financially self-sufficient. (1991 Code § 16-104; amd. 2013 Code)

A. Notice Required:
1. The city shall require a twenty four (24) hour notice by the owner of the lot or his duly authorized representative before a grave is opened.
2. The owner of the lot shall be required to also give twenty four (24) hours' notice to the city if a person not of the owner's immediate family is to be buried.
B. Number Of Persons In Single Grave Plot:
1. No more than one adult shall be buried in a single grave plot, except by written consent of the city (this does not refer to the possible burial of a child or children with an adult). Stacked vaults are not permitted.
2. Ashes from cremation are not considered human remains. Ashes may be buried in an occupied grave plot. The ashes must be buried at least eighteen inches (18") deep, in a container within a gravesite owned by the family.
C. Rights Of Deceased Plot Owner: Property rights of deceased plot owners will be held inalienable for the family or descendants. (1991 Code § 16-101; amd. 2013 Code; Ord. 22-38, 10-11-2022)
A. Flush With Ground: All grave markers shall be flat and laid flush with the ground surface in section A of the Elgin Memorial Cemetery. Upright headstones are allowed in other sections of the Elgin Memorial Cemetery and in Elgin Cemetery.
B. Size: A single grave marker in section A of Elgin Memorial Cemetery shall be no larger than two feet by three feet (2' x 3'). A double marker for two (2) plots in section A of Elgin Memorial Cemetery shall be no larger than six feet by three feet (6' x 3'); both plots must be owned to place a double marker.
C. Supervision Of Installation: The city shall have the sole right to supervise the installation of grave markers, and a twenty four (24) hour notice must be given to the city prior to the installation of any markers.
D. Foot Markers: Foot markers are allowed for military veterans only and must be laid flush with the ground surface. (1991 Code § 16-102; amd. 2013 Code; Ord. 22-38, 10-11-2022)
A. Surfaces Kept Flat: Grave surfaces shall be kept flat.
B. Unattended Children: Children under fourteen (14) years of age, unattended by an adult, shall not be permitted at any time.
C. Firearms: No firearms shall be allowed on the cemetery grounds, except for military funeral purposes.
D. Specifications Of Outer Box For Burial: All burials within the cemetery shall include an outer box, said box shall be of concrete or metal, minimum, and shall not be of wooden construction.
E. Permanent Vases: Permanent vases must be installed on the grave marker.
F. Shrubs, Flowers, Bushes: Planting of shrubs, flowers or bushes is prohibited.
G. Fences And Boarders: Fences or boarders of any kind are prohibited around plots. (1991 Code § 16-103; amd. 2013 Code; Ord. 22-38, 10-11-2022)
