§ 37.01 FEE AND FINE SCHEDULE.

   FEE SCHEDULE
   The fines in this Chapter 37 are minimum amounts.
   (A)   Taxation (Chapter 35).
      (1)   Returned and NSF checks: $35 plus all related bank charges
      (2)   Freedom of Information Act (FOIA) fees:
         (a)   Black and white, letter or legal sized copies
            1.   First 50 pages are free: No fee
            2.   Additional pages over 50 pages: $.15 per page
         (b)   Color or all other sized copies: Actual cost of copying
         (c)   Electronic copies: Actual cost of electronic device used
      (3)   Collection fee and penalties: Collection fees and penalties may be imposed for debts due and owing the Village pursuant to § 10.20, Debts due and owing the village, of the village code.
      (4)   Accounts receivable interest: $5 minimum monthly charge or 1.5% monthly interest rate, whichever is greater
      (5)   Lien fees:
         (a)   Cost of placing the lien on the property: $35
         (b)   Cost of removing the lien on the property: $35
         (c)   Administrative charge: $80

      (7)   Extraordinary police services/special detail rate. Police services will be equal to time and one-half pay rate for top step patrol officer, as established for that fiscal year on a two-hour minimum basis.

         (a)   Prepayment reduction of fine. Full fine amount is due and may be payable by mail within 30 days of issue. 50% of the fine amount may be paid by mail if done so within 15 days of issue date.
      (3)   Each dwelling unit to which the village garbage collector provides waste material collection shall be billed bi-monthly at the monthly rate set forth below:
         (a)   September 1, 2017 through September 30, 2018: $19.90;
         (b)   October 1, 2018 through September 30, 2019: $19.90 + CPI*;
         (c)   October 1, 2019 through September 30, 2020: (Price as of September 30, 2019) + CPI*;
         (d)   October 1, 2020 through September 30, 2021: (Price as of September 30, 2020) + CPI*;
         (e)   October 1, 2021 through September 30, 2022: (Price as of September 30, 2021) + CPI*.
*The CPI rate shall be the Consumer Price Index for all urban consumers in the Chicago-Gary-Kenosha area for the 12 months before October 1st and shall not be less than 1.5% and not greater than 3.0%.
   (E)   Water service (chapter 51).

      (1)   Building permit fees. The total fee for building permits includes the permit fee, which pays for inspections and the plan review fee, which pays for the plan examination. The building permit fees are based on cost of construction. These fees are based on either the contractor's estimated building valuation or the building officials assigned valuation, which shall be calculated using building area from the plans and building valuation data from a national source. When there is a difference between the contractor's valuation and the assigned valuation, the higher valuation will be used. The plan review fee must be paid at the time the plans are submitted for review and is nonrefundable. The permit fee must be paid at the time the permit is issued. There is a minimum permit fee of $50 (plus plan review fee) to cover basic administrative and inspection costs associated with any building project. Fees for all trades shall be rounded to the next whole dollar.

      (7)   Waiver of fees. Waiver of building permit fees as set forth in this schedule may be granted by action ofthe Village Board pursuant to the following standards:
         (a)   That the applicant be a not-for-profit corporation duly organized under the laws of any state and authorized to do business in the State of Illinois whose action or service will benefit the citizens of the village, and does not have any uncorrected building or zoning violations and has not started any construction without the properly approved permits.
         (b)   That the applicant has a currently effective determination from the Internal Revenue Service that it qualifies as an organization subject to the provisions of Internal Revenue Code, (Section 50l)(c)(3).
         (c)   As to all such qualifying applicants, the following fee shall apply:
            1.   An amount equal to 75% of the village internal permit and inspection fees attributable to the village staff inspectors may be waived
            2.   The applicant shall be required to pay 100% of fees and costs incurred by the village in the course of such inspections, including but not limited to, outside consultant fees, professional review fees, and inspectors hired as third party contractors by the village for purposes of review, including all site inspections and inspections completed by the East Dundee and Countryside Fire Protection District.
            3.   Any duly organized for profit or not-for-profit corporation authorized to do business in the State of Illinois, which is not qualified under division (c)(2) above shall be reviewed on a case-by-case basis. If the Village Board, in its sole discretion, makes the determination that such organizations substantially serve a public purpose, including charitable or educational purposes, or that such organizations substantially further an important public interest, then the Board may waive fees as provided herein.
         (d)   Waiver of fees. A waiver of building permit related fees for government and duly organized not-for-profit corporation may be granted by action of the Village Board and will be reviewed on a case-by-case basis.

         (a)   The petition in each of the foregoing shall be liable to the village for the payment of all incurred costs and expenses incurred by the village, including but not limited to engineering fees, attorney's fees, staff time, planning and landscape consultant fees. The petitioner shall be required to execute an agreement with the village prior to filing such petition whereby all such costs incurred by the village shall be paid and/or reimbursed by the petitioner, the petitioner shall deposit with the village an amount equal to the estimate cost as determined by the Building Department. Any unused funds will be returned to the petitioner.
         (b)   All petitioners shall be required to deposit a sum as set forth above to be applied by the village to reimburse its costs incurred in taking a transcript of the proceedings of the Plan Commission related to such petition.
         (c)   When residential petition requests both a zoning amendment as well as a special use, only one application fee shall be charged.
         (d)   When the petitioner requests an amendment to a previously approved planned unit development, the fee charged shall be the same as that set forth above as to all acreage affected by such amendment.
      (4)   Prohibited parking in front yard: $60
         (a)   Prepayment reduction of fine. Full fine amount is due and may be payable by mail within 30 days of issue. Fifty percent of fine amount may be paid by mail if done so within 15 days of issue date.
   (II)   Use of the Depot and Depot Park:
      (1)   Depot and Depot Park: $50 for resident, $100 for non-resident per day.
      (2)   Depot or Depot Park: $25 for resident, $50 for non-resident per day.
      (3)   Power access for musicians: $25 per day.
      (4)   Security deposit: $100 per day.
