§ 51.21 PROTECTION FROM DAMAGE.
   (A)   No unauthorized person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenances or equipment which is a part of the water facilities. No unauthorized person shall repair, remove or replace any equipment, appurtenances or property of the water facilities.
(B)   The Village President shall have the authority by proclamation to restrict the use of water in the village in order to ensure adequate water supplies.
      (1)   (a)   When watering restrictions are in force, all outside use of water shall be limited to between the hours of 6:00 a.m. and 10:00 a.m. each morning and between 6:00 p.m. and 10:00 p.m. each evening. Outside use of water for any purpose shall be prohibited at all other hours when the limitations are in effect, except hand-on hose water uses, which are permitted at all times.
         (b)   For the purpose of this division (B)(1), the following definitions shall apply unless the context clearly indicates or requires a different meaning.
            HAND-ON-HOSE WATER USAGE. Watering of trees or other non-grass ornamentals when the hose is held by the user at all times. Home and car maintenance is permitted when using an automatic flow control device that shuts off the water when not in use and is only on when held by the user.
            OUTSIDE USE OF WATER. Watering of lawns and outside vegetation, filling of swimming pools, and the like.
      (2)   The restriction on water usage shall be enforced as follows:
         (a)   All residential, commercial, industrial and institutional properties designated by a street address with an even number shall be permitted to use outside use of water on even numbered days of the month only.
         (b)   All residential, commercial, industrial and institutional properties designated by a street address with an odd number shall be permitted to use outside use of water on odd numbered days of the month only.
         (c)   Any exceptions to the above restrictions shall require a special village permit. The exceptions shall only be authorized by the Superintendent of Public Works or the Village Board.
      (3)   Signage placed within the village announcing the watering restrictions shall have the following meanings:
         (a)   Green: unrestricted watering;
         (b)   Yellow: the above described even/odd days restrictions apply. Hand-on-hose is permitted without restriction; and
         (c)   Red: all outside water use is strictly prohibited. Hand-on-hose water usage hours of allowed use may be permitted or prohibited by the Village President at time of red restriction declaration.
      (4)   Signage for watering shall be posted at major intersections as set by the village.
   (C)   In case of making repairs or alterations or constructing new facilities or for any other reason, the village reserves the right to shut off the water at once and keep it shut off as long as may be necessary by giving reasonable notice thereof as shall be practicable to users. No claim shall be made against the village by reason of the above or by reason of the breakage or failure of any pump or other portion of the water system.
