14-1-010: ADOPTION OF STATE MOTOR VEHICLE ACT, TRAFFIC CODE, AND RELATED PROVISIONS:

Utah Code Annotated title 41, chapters 1a, 6a, 8, 12a, 21 and 22, as amended, are hereby adopted by this reference as if fully set forth in this code; provided, however, that those provisions which are exclusive to the state of Utah or which are not enforceable by Draper City under the laws of the state of Utah, are excluded. 14-1-020: ADOPTION OF STATE TRANSPORTATION CODE:

Utah Code Annotated title 72, as amended, the transportation code, is hereby adopted by this reference as if fully set forth in this code; provided, however, that those provisions which are exclusive to the state of Utah or which are not enforceable by Draper City under the laws of the state of Utah, are excluded. 14-1-030: ADOPTION OF STATE DRIVER LICENSE ACT:

Utah Code Annotated title 53, chapter 3, as amended, known as the "uniform driver license act", is hereby adopted by this reference as if fully set forth in this code; provided, however, that those provisions which are exclusive to the state of Utah or which are not enforceable by Draper City under the laws of the state of Utah, are excluded. 14-1-040: SHORT TITLE:

This title and the codes adopted herein shall constitute the DRAPER CITY TRAFFIC CODE. (Ord. 1054, 7-30-2013)

14-1-050: RULES OF CONSTRUCTION:

Insofar as possible, the provisions of this title and the Utah Code Annotated provisions adopted herein shall be construed in a manner to ensure the enforcement of the traffic laws of the state of Utah. In the event any provisions are inconsistent, the inconsistency shall be resolved as follows:

A.   Any provision of this title which was at one time, but is not now, consistent with the provisions adopted herein shall be controlled by the law as it is reflected in the most recent version of the provision, as amended.

B.   Any provision of this title which deals with the particular local needs and policies of Draper City and is otherwise lawful shall control. (Ord. 1054, 7-30-2013)

14-1-060: CITY TO ADMINISTER:

Draper City is hereby vested with the powers necessary to administer the provisions of the Draper City traffic code and all laws relating to the operation of vehicles on the highways of the city. (Ord. 1054, 7-30-2013)

14-1-070: APPLICABILITY GENERALLY:

Pursuant to the authority vested in municipalities under Utah Code Annotated section 10-8-30, as amended, and to the extent permitted by law, the Draper City traffic code shall be applicable to all vehicular traffic and parking on any public roads, streets and highways within the jurisdiction of Draper City. The provisions of the Draper City traffic code shall be enforceable by any law enforcement officer having jurisdiction over such roads, streets and highways. (Ord. 1054, 7-30-2013)

14-1-080: APPLICABILITY TO SCHOOL PROPERTY:

Pursuant to Utah Code Annotated section 53A-3-504, as amended, the Draper City traffic code is hereby made applicable to vehicular traffic and parking on all public school property within Draper City. All law enforcement officers having jurisdiction within Draper City are hereby vested with the authority to interpret and enforce the traffic code of Draper City to vehicular traffic and parking on all public school property within Draper City.
