§ 70.10 BOARD OF WORKS AUTHORITY.
   The Board of Public Works and Safety is authorized to promulgate such rules and regulations, to establish such procedures and to do any and all other acts as are, in its discretion, necessary to carry out the provisions, intent and purpose of this traffic code.

§ 70.11 OPERATING MOTOR VEHICLE ON SIDEWALK PROHIBITED.
   (A)   It shall be a violation for anyone to operate a motor vehicle upon the public sidewalks of the city.
   (B)   Whoever violates this section will be subject to the penalty provisions set forth in § 70.99 of this code of ordinances.

§ 70.12 OPERATING MOTOR VEHICLES ON CITY PROPERTY PROHIBITED.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      MOTORIZED VEHICLES. Any motor vehicle (gas or electric), regardless of whether it navigates on wheels or any other mechanism. This definition includes, but is not limited to, all-terrain vehicles, four-wheelers, snowmobiles, automobiles and motorcycles.
      OFF ROAD. Those areas of city owned property which are grassed, landscaped, mounded, wooded or not otherwise designed for use by motorized vehicles or those areas which have been marked “No Trespassing”.
   (B)   It shall be unlawful and a violation of this section to operate a motor vehicle off road on city owned property unless authorized by state law, authorized by other provisions of the 2014 Decatur City Code of Ordinances or authorized by the City Board of Public Works.
   (C)   Employees of the city, as well as city contracted personnel, shall be exempt from this section.

§ 70.99 PENALTY.
   (A)   (1)   Fines. Every person convicted of a violation of any of the provisions of this traffic code for which another penalty is not provided herein shall, for the conviction thereof, be punished by a fine of not more than $100.

      (2)   Removal of vehicle. In addition to the foregoing penalty, any police officer, upon discovering any vehicle parked or stopped, in violation of this traffic code, may remove the vehicle or cause the same to be removed by private towing contractors approved by the Board of Public Works and Safety of the city to their vehicle impoundment sites where such vehicle shall be released only upon payment for the cost of towing such vehicle away from the place where it was illegally parked or stopped together with the cost to storage.

      (3)   Penalty; miscellaneous violations. Any person who violates any of the provisions of this traffic code, except as otherwise specifically provided in this chapter or in any other chapter of this traffic code, shall, upon conviction, be fined any sum not less than $10, nor more than $100.

   (B)   A person who violates § 70.12 of this chapter shall be assessed a fine of at least $100, but not more than $500. Each violation of § 70.12 of this chapter shall constitute a separate offense subject to separate fines. In addition, a person who violates § 70.12 of this chapter and causes damage to city owned property shall be responsible for making full restitution to the city for such damage.
