A. The Mayor shall appoint competent, qualified staff and employees and shall have the power to dismiss, suspend and discipline, in accord with the Charter, the Code and applicable laws, any Municipal employees under the Mayor's control. The Mayor also has the power to authorize a department Director or Manager or a staff member responsible to the Mayor to appoint and remove subordinates serving under that department Director or Manager or a staff member.
B. Regardless of title, the Mayor shall appoint the Director of the department relating to information technology, subject to confirmation by the City Council. The Director of this department may report directly to the Mayor, the Chief of Staff, or another designee. (Ord. 11-18; Ord. 18-78)
The Mayor shall have the power to set aside any executive or administrative action taken by a department, division, office, agency or Municipal enterprise Director or Manager. The Mayor may supersede any department, division, office, agency or Municipal enterprise Director or Manager in that position, except for those positions appointed by the City Council pursuant to the Charter, and the City Attorney. The Mayor shall have the power to direct any Municipal department, division, agency, or office to perform work for any other department, division, agency, or office. Where any specific administrative official is directed by this Code to act, it is expressly understood that the Mayor, as executive and administrative head of the Municipal government, has appointed that person to the administrative position and that any act taken is subject to the Mayor's delegation of authority and consent. The Mayor shall have the power to designate committees necessary for the proper consideration of executive or administrative problems. These committees shall meet at the direction of the Mayor and shall make recommendations on matters referred to it in the best interests of the City. (Ord. 11-18)
The Mayor shall have charge and supervision over all accounts and records of the City, and all boards or groups required to keep or make accounts. The Mayor may inspect or cause to be inspected all records or accounts required to be kept in any of the offices or departments of the City, and cause proper accounts and records to be kept and proper reports to be made. The Mayor shall examine, or cause to be examined, the books and affairs of any person, persons or corporations operating public service utilities which are required by law, by Charter or by ordinance to make reports to the City or any of its officers. The Mayor shall collect all franchise taxes, payments in lieu of taxes, rental or other monies which may be due or become due to the City from public utility corporations. The Mayor shall report to the Council any refusal to permit an examination, and make any related recommendation as the Mayor deems proper. (Ord. 11-18)
The Mayor shall have the power to investigate and examine or inquire into the affairs or operations of any department, division, agency or office of Municipal operations and Municipal enterprises under the Mayor's supervision and control, and to request the assistance of the City Auditor and the City Attorney.
