§ 141.22 Division of Air Quality
   There is hereby established in the Department of Public Health, a Division of Air Quality to be administered and controlled by the Commissioner of Air Quality, subject to the provisions of the Charter and the ordinances of the City, and to the direction of the Director of Public Health.

§ 141.23 Duties of the Commissioner of Air Quality
   The Commissioner of Air Quality shall administer and enforce the ordinances of the City of Cleveland relating to air quality; confer, as appropriate, with State of Ohio and federal agencies in regard to environmental matters; plan, manage and implement divisional air program and policies; develop environmental policy recommendations; supervise the preparation of air pollution permits, including enforcement and compliance monitoring; oversee all relevant environmental issues; supervise enforcement, monitoring, permitting and information control; and perform such other duties as may from time to time be required by ordinance or the Director of Public Health.

   Note: Section 4 of Ordinance No. 1531-02, passed October 14, 2002, effective October 17, 2002, reads as follows: “That any references contained in the Codified Ordinances of Cleveland, Ohio, 1976, to the Division or Bureau of Air Pollution Control shall be amended to read “Division of Air Quality”. Also, any references contained in the Codified Ordinances of Cleveland, Ohio, 1976, to the Commissioner of Air Pollution Control shall be amended to read “Commissioner of Air Quality” consistent with this ordinance.”
   Section 5 of Ordinance No. 1531-02, passed October 14, 2002, effective October 17, 2002, reads as follows: “That the Clerk of Council is authorized, when publishing the Codified Ordinances of Cleveland, Ohio, 1976, and amendments thereto, to change all references to the Division or Bureau of Air Pollution Control to read “Division of Air Quality” and to change all references to the Commissioner of Air Pollution Control to read “Commissioner of Air Quality”.
§ 141.24 Division of Health Equity and Social Justice
   There is established in the Department of Public Health a Division of Health Equity and Social Justice to be controlled and administered by a Commissioner of the Health Equity and Social Justice, subject to the provisions of the Charter and ordinances of the City, and to the supervision and direction of the Director of Public Health.

§ 141.25 Duties of the Commissioner of Health Equity and Social Justice
   The Commissioner of Health Equity and Social Justice shall administer the Health Code and see that all ordinances and rules of the City and all applicable State laws affecting the public health are properly enforced. He or she shall supervise the work of the several bureaus as may be established in the Division of Health Equity and Social Justice. He or she shall examine and address health inequities across the City and shall review differing opportunities for healthcare by demographic sub-populations and geographic areas. He or she shall analyze social well-being and social determinants of health, including but not limited to, aspects of the social environment, such as racism, discrimination, income, education level, and marital status; the physical environment, such as place of residence, crowding conditions, and built environment (buildings, spaces, transportation systems, and products that are created or modified by people); and health services, such as access to and quality of care and insurance status. He or she will conduct assessments of health equity in communities and systems to identify the behavioral, cultural, social, environmental and organizational determinants that promote or compromise health in disadvantaged groups. He or she shall identify evidence-based strategies and measurable goals and objectives to promote health equity and social justice; and shall implement effective, efficient and culturally sensitive strategies to improve health equity and social justice. He or she shall perform all other appropriate duties that are critical to advancing the mission, duties and responsibilities of the Division of Health Equity and Social Justice.

§ 141.26 Charges for Services
   (a)   The Director of Public Health shall charge each patient for service rendered at clinics and other health facilities operated by the City of Cleveland in accordance with a sliding scale schedule of fees approved by the Board of Control.
   (b)   The Director of Public Health is authorized to enter into agreements with Medicaid, Medicaid HMOs, Medicare, and other insurance carriers for third-party billings.
   (c)   The Director of Public Health shall also charge for the analysis of blood samples for lead performed at the lead laboratory operated by the City of Cleveland, in accordance with a sliding scale schedule of fees approved by the Director of Public Health. The schedule of fees charged for the analysis of blood samples for lead performed at the lead laboratory operated by the City shall not exceed the cost of the analysis.
   (d)   Charges and fees received from patients under this section shall be placed into a revolving fund which will be used to provide additional services under this section.
   (e)   All fee schedules, including the sliding scale formula, shall become effective upon their publication in the City Record.
