§ 401.151 Electric Personal Assistive Mobility Device
   “Electric personal assistive mobility device” means a self-balancing two (2) non-tandem wheeled device that is designed to transport only one (1) person, has an electric propulsion system of an average of seven hundred fifty (750) watts, and when ridden on a paved level surface by an operator who weighs one hundred seventy (170) pounds has a maximum speed of less than twenty (20) miles per hour.

§ 401.152 E-Bike
   E-Bike or "electric bicycle" is a two (2) wheeled device that has handlebars, a seat, and pedals designed to be operated similar to a bicycle, and is powered by electricity. E-Bike or "electric bicycle" means a "class 1 electric bicycle", a "class 2 electric bicycle", or a "class 3 electric bicycle" and is further defined as follows:
   (a)   "Class 1 electric bicycle" means a bicycle that is equipped with fully operable pedals and an electric motor of less than seven hundred fifty (750) watts that provides assistance only when the rider is pedaling and ceases to provide assistance when the bicycle reaches the speed of twenty (20) miles per hour.    (b)   "Class 2 electric bicycle" means a bicycle that is equipped with fully operable pedals and an electric motor of less than seven hundred fifty (750) watts that may provide assistance regardless of whether the rider is pedaling and is not capable of providing assistance when the bicycle reaches the speed of twenty (20) miles per hour.    (c)   "Class 3 electric bicycle" means a bicycle that is equipped with fully operable pedals and an electric motor of less than seven hundred fifty (750) watts that provides assistance only when the rider is pedaling and ceases to provide assistance when the bicycle reaches the speed of twenty-eight (28) miles per hour. § 401.153 E-Scooter
   "E-Scooter" means a two (2) wheeled device that has handlebars, a floor board, designed to be stood upon when operating and is powered by electricity. The electricity is stored on board in a rechargeable battery.
