§ 3126.08 Final Grade Slope
   (a)   General. An excavation and fill permit may not be issued for an excavation or fill to be made with a face steeper in slope than three (3) horizontal to one (1) vertical.
   (b)   Grading Protection – Adjacent Properties. If an excavation or fill is to be graded to a higher or lower finished grade level steeper than in slope than three (3) horizontal to one (1) vertical or steeper than the natural grade on an adjacent property, the permit applicant shall provide suitable retaining wall or walls or other approved slope protection as necessary to maintain the existing natural grade of such adjacent property to prevent soil caving.
   (c)   Exception. The Director of Building and Housing may permit an excavation or fill to be made with steeper face if an applicant demonstrates satisfactorily by means of appropriate soil exploration and analysis and the written and stamped opinion of the geotechnical engineer that the materials are capable of standing on a steeper slope without creating the hazards described herein.
   (d)   No excavation or fill to be made shall have a slope steeper than three (3) horizontal to one (1) vertical without construction of a suitable retaining wall or other approved slope protection as necessary to safely maintain the existing natural grade of the adjacent property.
