18-11-1107.5.5 Housing owned or financed by a governmental unit and developments with affordable units.

   The provisions of this subsection shall apply to projects with residential occupancies in which some or all of the dwelling units and sleeping units are owned or financed by a governmental unit in which there are five or more dwelling units on each project site, and to affordable units, including privately financed affordable units, in a project in which some or all of the units are constructed as affordable units. Type A units, Type B units and visitable units shall be provided in accordance with Sections 18-11-1107.5.5.1 through 18-11-1107.5.5.5. The minimum number of units required to comply with Section 18-11-1107.5.5.1 shall not be counted as satisfying the minimum number of units required to comply with Section 18-11-1107.5.5.3.

   Exception: Buildings that are four stories or more in height containing 10 or more dwelling units shall comply with Sections 18-11-1107.5.2 and 18-11-1107.5.3, as applicable, and shall not be counted as part of the project for purposes of determining the required number of units in accordance with this section.
