For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
OPERATE. To ride in or on and be in actual physical control of the operation of a snowmobile.
OPERATOR. Any person who operates or is in actual physical control of a snowmobile.
OWNER. Any of the following:
(1) A person who holds the legal title to a snowmobile.
(2) A vendee or lessee of a snowmobile which is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee.
PASSENGER. The second person on a snowmobile who is not in physical control of that same snowmobile.
SNOWMOBILE. Any motor driven vehicle designed for travel primarily on snow or ice of a type which utilizes sled type runners or skis, or an endless belt tread or any combination of these or similar means of contact with the surface upon which it is operated.
STREET. The entire width between the boundary lines of every way publicly maintained with the city when any part thereof is open to the use of the public for purposes of vehicular travel including the shoulders and non-paved areas thereof.

(A) No snowmobile shall be operated within the city unless registered in accordance with the provisions of Public Act 451 of 1994, being M.C.L.A. §§ 324.82103 to 324.82105, and as provided in this chapter and identification numbers must be displayed as may be required thereby.
(B) City residents using city streets other than the designated snowmobile route are permitted access to the designated snowmobile trail across city streets by the issuance of an authorized permit from the city for guests and residents to access snowmobile routes provided that, upon issuance of a permit, the permit holder shall attach an assigned city snowmobile registration number in a minimum of three-inch letters clearly visible at a distance of 50 feet or more on each side of the snowmobile. The tire registration number display requirement is waived for guest.
(C) Operators of permitted snowmobiles under city street use permit will be required to carry the registration for each snowmobile on his/her person.
(D) Each machine operating on designated city streets shall carry a city permit depicting the most direct route from residence to the designated trial.
(E) It shall be considered prima facia evidence if the operator of a snowmobile in violation of this chapter cannot be identified and the registered owner shall be deemed to be the operator of the snowmobile and responsible for the violation.
(F) All snowmobiles operating on city streets other than the designated snowmobile route streets shall be subject to investigation by any peace officer.

(A) The following described streets are hereby designated as streets that access the snowmobile trail route:
(1) West side.
(a) Lincoln Avenue Huron Street to the DNR snowmobile trail at Western Avenue eastbound and westbound/shoulder.
(b) Huron Street shoulder from Mill Street, to Lincoln Avenue northbound and southbound.
(c) Division Street from DNR trail to Huron Street eastbound and westbound.
(d) Mill Street, east and west, from Main Street to Huron.
(2) East side.
(a) East Lincoln Avenue shoulder and right-of-way from Lincoln Avenue Bridge to South Street.
(b) Eastern Avenue shoulder from Duncan Avenue to Vanyea Road west to DNR trail.
(c) Lafayette Avenue shoulder from East State Street south to DNR trail which intersects Lafayette Avenue.
(B) Sidewalk and right-of-way routes include the following:
(1) From Lincoln Avenue to Taylor Street along Main Street for two-way snowmobile traffic.
(2) From the north and south sides of the Lincoln Avenue Bridge for east and west travel across the bridge on the bridge sidewalks.
(3) Lincoln Avenue sidewalks from Huron Street eastbound and westbound to Main Street.
(4) On the west side of Main Street from Lincoln Avenue south to the city limits.

(A) It shall be unlawful for a person to operate a snowmobile in the city in the following manner or under the following conditions:
(1) At a rate of speed greater 15 miles per hour;
(2) On or across a cemetery or burial ground;
(3) Within 100 feet of a slide, ski or skating area;
(4) On private property without consent of the property owner or his agent;
(5) With more than one passenger on a snowmobile;
(6) While towing any conveyance other than one specifically designed to be towed by a snowmobile;
(7) Between the hours of 12:00 midnight and 7:00 a.m.;
(8) In any parade or safari unless specifically authorized by the Police Chief with adequate safeguards for policing and appropriate escort.
(B) Any person operating a snowmobile within the city limits shall:
(1) Operate the snowmobiles only on designated city streets, sidewalks or DNR trail as provided herein, and travel only in single file;
(2) Obey all traffic signals, signs and devices;
(3) Yield the right-of-way to all vehicular traffic and pedestrians.
(C) No snowmobile may be operated on any state trunk line within the city or on Huron Street from State Street to Court Street.
