(a) The County Commissioners of Carroll County are authorized and empowered to employ a competent person to serve as special police officer of Carroll County at a salary to be fixed by the County Commissioners, payable monthly.
(b) The person appointed shall be capable of doing finger print and identification, criminal investigation and detective work, and be sworn in by and perform the person’s duties under the direction and supervision of the County Commissioners, in cooperation with the State’s Attorney for Carroll County. The special police officer shall have and exercise all the powers and jurisdiction of the regular law enforcement officers within the limits and confines of Carroll County. If the County Commissioners, in their discretion, shall appoint a special police officer, they may designate the special officer to act as inspector for the Board of License Commissioners, with all the powers which inspectors of Boards of License Commissioners have under the general law.
(c) The County Commissioners shall pay in addition to the salary under subsection (a) of this section the necessary expenses, not exceeding however twenty-five dollars ($25.00) per month, incurred by special officer in the performance of the special officer’s official duties, and shall levy for the salary as general expenses of the County. All bills for the expenses of the officer must be verified by an affidavit and presented direct to the County Commissioners on forms in use by the County Commissioners, and any false swearing in the affidavit shall be deemed perjury and be punished as perjury.

(a) The County Commissioners of Carroll County are authorized to appoint an executive or administrative assistant to the County Commissioners, who shall receive the compensation and have the powers and duties as determined and prescribed by the Commissioners. The executive or administrative assistant shall be appointed to a term of 4 years which shall begin July 1 of the year following the last general election at which the Board of County Commissioners was elected, and shall be eligible to reappointment by any successor Board. The person so selected shall be a registered voter and taxpayer in Carroll County. After the person’s appointment by the Commissioners, the person shall take the oath prescribed by Section 9 of Article I of the Constitution of Maryland*, and may be required to give bond for the faithful performance of the duties of the person’s office in the amount that the Commissioners may prescribe, and the person’s services in such office may be terminated at any time by Commissioners upon not less than two months’ written notice, except that, in the case of termination for cause, the termination shall take effect immediately.

(b) Qualifications. The executive assistant shall be selected for the position on the basis of merit, shall have had a minimum of seven years’ experience in municipal administration or similar-type business administrative functions. Each year of education at a recognized college or university in business or public administration or in another field which may be approved by the County Commissioners may be substituted for one year of experience in arriving at the minimum years of experience required to qualify for the position of executive assistant.
(c) Powers and duties. The executive assistant shall have the powers and duties prescribed by the County Commissioners including; supervision and coordinating those general policies and instructions of the County Commissioners with respect to the several departments or administrative agencies of the County, the representation of the County Commissioners as liaison officer at those departmental and administrative agencies having functions affecting Carroll County, and to recommend to the County Commissioners from time to time policies, regulations or procedures which will aid in increased efficiency in the administration of the County’s affairs.
(d) Same; Clerk to County Commissioners. The County Commissioners may authorize the executive or administrative assistant to serve as Clerk to the County Commissioners. The executive or administrative assistant shall give the person’s personal attendance at the office of the County Commissioners during business hours. The executive or administrative assistant is authorized to administer an oath or affirmation to any person presenting a claim to the Commissioners against the County. In no case shall the executive or administrative assistant hold any other county job.
(e) Deputy. The County Commissioners shall have full authority to make a temporary appointment of a deputy administrative assistant to perform the duties of the executive or administrative assistant in the event that illness or other just causes render the executive or administrative assistant unable to perform the person’s duties as defined by law.

The County Attorney shall be appointed to a term of 4 years which shall begin on July 1 of the year following the general election at which the Board of County Commissioners was elected, and shall be eligible for reappointment at the conclusion of the County Attorney’s term of office. The person so appointed shall be a registered voter and taxpayer in Carroll County. After the County Attorney’s appointment, the County Attorney shall take the oath prescribed in Section 9 of Article I of the Constitution of Maryland*. The Commissioners may terminate the County Attorney’s services at any time upon not less than 2 months’ written notice, except that, in the case of termination for cause, the termination shall take effect immediately.

(b) The County Attorney shall have been a member of the Maryland Bar for at least 3 years.
(c) The County Attorney shall have the powers and duties as prescribed by the County Commissioners including:
(1) advise the agencies of the County and the County Commissioners, when requested, upon all legal questions arising in the conduct of county business;
(2) prepare or revise ordinances and resolutions when requested;
(3) give an opinion upon any legal matter or question submitted to the County Attorney by the Commissioners, or upon the interpretation of any county ordinance or resolution when requested by any agency or officer of the County;
(4) attend all meetings of the County Commissioners when requested;
(5) prepare or approve for execution all contracts or instruments to which the County is a party and shall approve all bonds required to be submitted to the County;
(6) prosecute and defend any and all writs or actions at law or in equity to which the County is a party, or may be interested;
(7) have charge of all legal services rendered by others on behalf of the County; and
(8) appoint such assistants and deputies as are approved by the County Commissioners, who, when approved, may act for the County Attorney with the powers as the County Attorney may delegate to them.

The County Clerk shall be appointed to a term of 4 years which shall begin on July 1 of the year following the general election at which the Board of County Commissioners was elected, and shall be eligible for reappointment at the conclusion of the County Clerk’s term of office. The person so appointed shall be a registered voter and taxpayer in Carroll County. After the County Clerk’s appointment, the County Clerk shall take the oath prescribed in Section 9 of Article I of the Constitution of Maryland*. The Commissioners may terminate the County Clerk’s services in such office at any time upon not less than 2 months’ written notice, except that, in the case of termination for cause, the termination shall take effect immediately.

(b) The County Clerk shall have the powers and duties as prescribed by the County Commissioners including:
(1) seal and attest all contracts and such other documents of the County which require this formality;
(2) keep a record of all ordinances and resolutions adopted by the County Commissioners, the minutes of the meetings of the County Commissioners, and other records as required by the County Commissioners;
(3) be the custodian of the seal and affix its impression on documents whenever this is required;
(4) be the custodian of all documents belonging to the County which are not assigned to the custody of some other officer; and
(5) perform such other duties and functions as may be required by the County Commissioners.
(c) Whenever the office of County Clerk is vacant, the County Commissioners may appoint a successor to the remainder of the term; or if the County Clerk be absent at any time for any reason, the County Commissioners may appoint a temporary replacement, who shall be a county officer or employee, and who shall serve without additional compensation.

(a) In contracting for any necessary public work or improvement or for the purchase of supplies and equipment needed at any time by the several departments of the County, the County Commissioners of Carroll County may enter into contracts for public work or improvement and may purchase supplies and equipment on an order passed by the County Commissioners provided that the cost of the public work or improvement or the purchase price of the supplies and equipment does not exceed $25,000.00.
(b) When the cost of any project for public work or improvement, or the purchase price of any supplies and equipment exceeds $25,000.00, except in emergencies or when there is a sole source of supply, the Chief of the Bureau of Purchasing for the County Commissioner shall provide public notice for at least one week in a media accessible to the general public including, but not limited to a newspaper circulated in Carroll County and an internet web site, for bids to perform the public work or improvement or to furnish the supplies and equipment. The public notice shall state the date, time and place of opening of the bids.
(c) The bids shall be opened in the presence of an employee designated by the County Commissioners of Carroll County.
(d) The County Commissioners of Carroll County shall award the contract to the lowest responsible bidder whose bid is considered reasonable, or in their discretion, may reject any and all bids.
(e) The County Commissioners may authorize nonprofit entities that are funded by the County or eligible to receive county funds, to participate in county procurement contracts.
(f) The County Commissioners may authorize the Chief of the Bureau of Purchasing to participate in cooperative or piggyback purchasing with other governmental agencies or associations, provided the public notice for the bid is in accordance with the rules and regulations governing the soliciting agency or association.
The Economic Development Commission of Carroll County is created for the purpose of advancing the general welfare of the people through programs and activities to develop Carroll County’s natural resources and economic opportunities pertaining to commerce, agriculture, forestry, transportation, travel, tourism and recreation, and to cooperate and offer assistance to existing industries and businesses, and to promote and encourage the establishing and locating of new industries and businesses in Carroll County and other matters intended to foster and develop gainful employment and the pursuit of happiness of all who are now or may become residents of Carroll County.
