923.01 DECLARATION OF PURPOSE.
   It is hereby determined and declared to be necessary for the due protection of the public health, safety and welfare of the Municipality to establish and collect charges for the use of the sewer system upon all lots, lands and premises served by or having connection with the sewer system.

923.02 USE OF MONEYS COLLECTED.
   The funds received from the collection of the rates and charges hereinafter provided shall be deposited as received with the Director of Finance who shall keep the same in a separate fund designated "Sewer Operating Fund". Subject to the provisions of any ordinance or indenture of mortgage authorizing the issuance of and securing mortgage revenue bonds for the system moneys in such fund shall be used for the payment of the cost and expense of operation, maintenance, repair and management of the system and for payment of debt charges on bonds issued for construction of the system and any reserves approved by Council, and any surplus in the Fund over and above the requirements hereinbefore mentioned may be used for enlargements of and replacements to the system and parts thereof.

923.03 RATE SCHEDULE.
   Effective with all sewer use billed beginning May 1, 2020, there is hereby levied and charged upon each lot, parcel of land or premises having a connection with the system, or receiving a benefit from the system, or otherwise discharging sewage, industrial wastes, water or other liquids either directly or indirectly into the system sewer charges payable as hereinafter provided and in amounts to be determined as follows:
   For each lot, parcel of land or premises, such charges shall be based upon the quantity of water used thereon or therein as the same is measured by the municipal water meter therein used, or other meters installed or approved by the Division of Water and Sewer and such charges shall be:
(a)   Domestic Sewer User
$9.68 per thousand gallons
(b)   Industrial, Exempt User
$9.68 per thousand gallons
(c)   Industrial, Type A User
$9.68 per thousand gallons
(d)   Industrial, Type B User
$9.68 per thousand gallons
(e)   Industrial, Type C User

   As used herein, the terms "extra-territorial users" and "extra-territorial purchasers" shall mean any purchaser of water from the City of Canfield which requires delivery of water outside the corporate limits of the City of Canfield, and is connected to, either directly or indirectly, the wastewater collection system of the City.
   In order to provide for adequate funds for system maintenance and improvements, the minimum charge per quarter shall be:

   The above-mentioned minimum sewer charges are based on the minimum gallons of flow prescribed by water meter size in Section 927.01(b) in the Codified Ordinances of the City of Canfield, Ohio.
   The City Manager shall determine minimum sewer charges for subsections (b), (c), (d), (e), (f) and (g) Classes of sewer users as defined by this Section.
   The sewer surcharge referenced in Section 923.04 will be added to the above-enumerated minimum gallons per water meter size.

923.04 CHARGES TO PAY BONDED INDEBTEDNESS.
   (a)   After January 1, 1999, there is hereby levied and charged upon each lot, parcel of land or premises having a connection with the Sanitary Sewer system, or otherwise discharging sewage, industrial wastes, water or other liquids either directly or indirectly into the system, a sewage surcharge payable as hereinafter provided for the purpose of paying Indebtedness of the City of Canfield sanitary sewer collection system. The sewer surcharge shall be determined as follows:
(1)   For each ten thousand dollars ($10,000) of Indebtedness, a maximum of $.028 per thousand gallons can be charged for each such lot, parcel of land or premise, based upon the quantity of water used thereon or therein as same is measured by the municipal water meter therein used, or other meters installed or approved by the Division of Water and Sewer. The aforestated charges of $.028 per thousand gallons shall be applicable to all categories of sewer users. Adjustments to this sewer surcharge will be made periodically by the Finance Director.
   (b)   The charges contained in this section shall only be assessed in the event of indebtedness in the sanitary sewer system and will only remain in effect until the Indebtedness is repaid.

923.05 MINIMUM CHARGE FOR MULTIPLE DWELLINGS.
   For multiple dwellings with heating and plumbing or with either, the charge shall be a minimum charge of thirty-five dollars and eighty-five cents ($35.85) each family unit each quarter.

923.06 SURCHARGE FOR LATE PAYMENT.
   Sanitary sewer charges that are not paid by the due date shall have a penalty of ten percent (10%) added to each bill. Sale of water shall be discontinued on sanitary sewer accounts unpaid fifteen (15) days after the due date of the bill.

923.07 UNMETERED DISCHARGES.
   In the event waste or sewage is discharged directly or indirectly into the system and the same is not measurable by a meter, then the City Manager shall make a determination based upon the sewer user charge system enacted of the quantity of waste or sewage so discharged and charge the contributor pursuant to Section 923.03.
