Village Fiscal Officer
   EDITOR’S NOTE: Pursuant to Ordinance 3917, effective March 1, 2017, the designations “Clerk” and “Treasurer” are changed to “Village Fiscal Officer”. Wherever the terms “Clerk” or “Treasurer” are used in any Codified Ordinance of the Village they mean the “Village Fiscal Officer”.

   133.01 APPOINTMENT AND DUTIES OF VILLAGE FISCAL OFFICER.
   (a)   There is hereby created the full-time position of Village Fiscal Officer. The Village Fiscal Officer shall be appointed by the Mayor subject to the confirmation by Council. The Village Fiscal Officer shall be responsible for the collection, disbursement and custody of all funds of the Village and shall establish and maintain those records and procedures necessary to perform the duties of the office. For any disbursement made by the Village Fiscal Officer greater than one thousand dollars ($1,000.00), the Mayor shall also approve and sign such instrument. The Village Fiscal Officer shall act as liaison between the Finance Committee, Mayor, and Council, and shall perform such other functions as may be assigned by the Mayor or by ordinance or resolution of Council.    (b)   The Village Fiscal Officer shall have those powers, duties and functions as provided by the general laws of the State of Ohio. All such general laws pertaining to a Village Clerk and a Village Treasurer shall apply to the Village Fiscal Officer. In addition, such Village Fiscal Officer shall be responsible for all the duties and procedures set forth in subsection (a) above and shall maintain the Drug Offenses Trust Fund as established by Bratenahl Codified Ordinance 135.03.
   (c)   The Village Fiscal Officer shall also serve as Clerk of Council and, as such, shall keep the journal of Council, an accurate and complete record of all proceedings of Council authenticated by his or her signature and have custody of all laws, ordinances and resolutions of Council; have custody of all official documents, reports, papers and files of Council, and shall perform other such duties as Council shall require.

   (d)   The Village Fiscal Officer shall also serve as the Village Tax Administrator who shall be responsible for the collection and deposit to the municipal treasury of municipal income taxes and the enforcement and administration of the municipal corporation’s income tax ordinances, resolutions, and rules including the powers, duties, and authority as set forth in Codified Ordinance Chapter 171 and 173.
   (e)   The Village Fiscal Officer shall have such assistance as provided by Ordinance of Council.
   (f)   The Village Fiscal Officer may be removed with or without cause by the Mayor with the consent of a majority of the Village Council. Should the Village Fiscal Officer voluntarily leave, he/she shall give the Village at least thirty (30) days notice.

   133.02 COMPENSATION OF VILLAGE FISCAL OFFICER.
   The salary of the Village Fiscal Officer shall be as provided by Council from time to time. The Village Fiscal Officer shall be entitled to participate in the OPERS pension benefit. (Ord. 3911. Passed 2-15-17.)
