The holder of every permit issued under this Part shall, on or before the date of expiration of his permit, refill the opening or excavation made by authority of such permit, and restore and resurface the portion of the street disturbed by such opening or excavation. Such work of refilling, restoration and resurfacing shall be in conformity with the specifications adopted therefor by the Borough. In case any person shall fail to perform such work of refilling, restoration and/or resurfacing within the prescribed time limit and in strict conformity to the Borough specifications, the Borough, under the direction of the Borough Manager, may proceed to do the said work of refilling, restoration and/or resurfacing and shall collect all costs and expenses incurred by the Borough in connection therewith, from the permit holder or other person in default. Provided: the Borough Manager, at his discretion, may require as a condition for the granting of any such permit, that the applicant file a bond with the Borough, in the amount prescribed by the Manager, conditioned that the permit holder perform all such work of refilling, restoration and resurfacing in conformity with Borough specifications.
