§11-106.   Occupancy Certificates.
   1.   No person shall occupy or reoccupy, or let to another to occupy or reoccupy, any dwelling or dwelling unit, rooming house or rooming unit, nor shall water, electric, and/or gas utilities be supplied by the Borough or a utility company until an occupancy certificate has been issued.
   2.   The certificate of occupancy shall be issued in the name of the owner as defined herein, and shall state that the dwelling, dwelling unit, rooming house or rooming unit is in conformance with this Part.
      A.   In addition, for a dwelling or dwelling unit the certificate shall contain the name of the individual or head of the household occupying said dwelling or dwelling unit, and shall contain an expiration date but in all cases shall expire upon a change in ownership or vacation of said dwelling or dwelling unit by the individual or head of household named in said certificate, unless sooner revoked as hereinafter provided.
      B.   For a rooming house the certificate shall contain the name of the operator, if different from the owner, and shall expire at the end of 1 year following its date of issuance, unless sooner revoked as hereinafter provided.
   3.   A certificate of occupancy shall be issued within 5 days after written application therefor or a statement shall be given, in writing, specifying the reasons why a certificate of occupancy cannot be issued.
   4.   Whenever any dwelling, dwelling unit, rooming house or rooming unit is found to contain violations of this Part, the Building Official shall give notice that unless the violations are corrected within a reasonable period of time, the occupancy certificate will be revoked, subject to appeal before the Board of Building and Housing Appeals.
   5.   A fee to be determined by the Borough Council shall be paid to the Borough for each certificate of occupancy.
   6.   Subsections .1 through .5 shall not apply to buildings completely erected and occupied at the date of enactment of this Part unless either the Mayor and the Building Official or any two members of the Borough Council shall complain to Council and cite the necessity of such a certificate in a specific case for the general welfare of said Borough. In such a case, the aforesaid provisions will be fully effective to such specifically cited property as well.
