There is hereby established an executive department to be known as the Law Department, which shall include the City Attorney, the City Prosecutor, and assistants, clerks and secretaries as the Council may by ordinance provide. All members of the Law Department, except clerks and secretaries, shall be attorneys at law duly licensed to practice in the state.

(A) Establishment. There is hereby established the office of the City Attorney. He or she shall be appointed by the Mayor, by and with the advice and consent of the Council.
(B) Duties. The City Attorney shall:
(1) Conduct the law business of the city, including all litigation and actions filed on behalf of or against the city;
(2) Draft ordinances and resolutions and render opinions as required by the Mayor and Council;
(3) Prepare deeds, leases, contracts and other documents required by the city, when requested to do so by the Mayor or Council; and
(4) Perform other duties as may be assigned by the Mayor or the Council.

(A) There is hereby established the office of Associate City Attorney who shall be appointed by the Mayor with the advice and consent of the City Council.
(B) The Associate City Attorney shall conduct hearings before the Liquor Control Commissioner, serves as the city’s Administrative Hearing Officer and perform other duties as may be assigned by the City Attorney, provided that the Associate City Attorney shall not render any legal opinions on behalf of or at the direction of the Mayor, City Council or any department head.

(A) Establishment. There is hereby established the office of City Prosecutor. He or she shall be appointed by the Mayor, by and with the advice and consent of Council.
(B) Duties. The Prosecutor shall prosecute all traffic violation cases and any other instance where there has been a violation of any of the ordinances of the city, and he or she shall file complaints when so directed by the City Attorney.
The City Attorney, Associate City Attorney and the City Prosecutor shall receive compensation as may be provided for by ordinance, which shall be based upon the fair, customary and reasonable charges made for similar services rendered by attorneys in the county.

Upon the expiration of their terms of office, or their resignation or removal therefrom, the Corporation Counsel, the City Attorney and the City Prosecutor shall forthwith, on demand, deliver to their successors in office all books, papers and information in their possession belonging to the city, or delivered to them by any of its officers, and all papers and information in their possession regarding actions prosecuted or defended by them then pending and undetermined, together with the register thereof and a record of the proceedings therein.
