(a) No person, partnership or corporation shall engage in the practice or business of garbage and/or rubbish collection within the City without having first obtained a permit from the Safety-Service Director.
(b) Applications for such permit may be obtained from the Director, and shall be completed and returned to the Director, containing the following information:
(1) Name and address of applicant.
(2) Name and address of applicant’s liability insurance carrier.
(3) A description of the type of equipment used by applicant, which equipment must meet all Federal, State and local health, safety and environment standards, laws and regulations.
(4) A list of the names and addresses of the applicant’s agents or employees who will participate in the collection of garbage and rubbish.
(5) A description of the services provided and methodology used by the applicant, which services and methodology must meet all Federal, State and local health, safety and environmental standards, laws and regulations.
(c) Applicants for a permit shall attach to their application the following:
(1) A financial statement, which must reflect financial stability of the applicant;
(2) A performance bond under the following schedule:

(3) Proof of liability insurance coverage in the amounts of at least one hundred thousand dollars ($100,000) per person, three hundred thousand dollars ($300,000) per incident, which policy must reflect the City of Belpre as an insured party in interest; and
(4) A permit fee in the amount of two hundred dollars ($200.00).
(d) Any permits issued pursuant to this chapter shall be of a one-year duration, and each permit holder shall submit a new permit application and permit fee on or before March 1, of each year following receipt of his (her) (its) initial permit.
(e) The Safety-Service Director shall monitor the performance of all permit holders, including the receipt and investigation of complaints as to collection service. If the Safety- Service Director determines that any complaint received is valid, he may issue a written warning to permit holder. Following the issuance of two warnings to any permit holder, and following notice to the permit holder and the opportunity for a hearing, the Director may revoke that permit, upon his finding that the permit holder’s services are inadequate to meet the public need and good. No person other than the contractor shall burn, bury, collect or transport over the public streets or alleys of the City any garbage or rubbish or other refuse except as authorized in writing by the Safety-Service Director. Newspapers and other paper may be burned in compliance with the City’s trash burning ordinance, however, there shall be no burning except in wire baskets, steel drums or other fireproof containers or incinerators.

(a) The Mayor is authorized to relieve from payment one-half of the fee for garbage collection of any person who in the Mayor’s discretion is unable because of lack of finances to make payment of the entire amount of the bill charged for the collection of the garbage, providing that the person requesting such a reduction in his bill must sign a statement before the Mayor that he is unable to make the payment.
(b) The Mayor shall submit to Council at least as frequently as annually a list of those persons to whom he has granted such relief and shall keep such a list available and up to date for examination by Council at any time during regular business hours throughout the year.
(c) The City shall make up the deficit, if any, to the garbage contractor caused by the relief provided herein.

Effective October 1, 2000, the finance officer is hereby authorized to bill and collect a monthly charge for commercial garbage and rubbish collection within the City of Belpre, Ohio, according to the schedule attached to Ordinance 12(2000-01) as Exhibit A, which charges shall be billed with monthly water and sewer charges.
(a) Whenever an assessment for commercial garbage and rubbish charges is not paid by a water consumer, a penalty of ten percent (10%) shall be added to bills not paid when due.
(b) The owner of any premises on which a tenant is the water consumer shall be liable for unpaid commercial garbage and rubbish collection charges, if the tenant fails to pay the assessment.
(c) If such assessments become delinquent for ninety (90) days or longer, such delinquency shall be certified to the Auditor of Washington County, Ohio, to be placed upon the property owner’s tax duplicate, with interest and penalties, for collection as other City taxes are collected.
