   1107.09 INDEMNITY INSURANCE.
   The applicant shall furnish indemnity insurance as is deemed necessary by the City. Such insurance shall indemnify, save harmless and defend the City from any and all liability arising by reason of the unimproved or partially improved condition of the roads and other improvements of the subdivision as such may arise or grow out of construction or installation of such facilities. The insurance shall be of duration determined by the City and in no case be allowed to expire earlier than the effective period of any maintenance bond. Expiration shall be grounds for the issuance of a stop work order. A copy of the insurance policy shall remain at all times with the Clerk.

   1107.10 MAINTENANCE GUARANTEE.
   (a)   A maintenance bond shall be furnished in an amount determined by the Director of Engineering, Utilities, and Inspection and for the following periods for each improvement:
      (1)   Two years, or longer with cause, from date of acceptance by the City for roads, sidewalks and pavement and facilities appurtenant thereto;
      (2)   Two years, or longer with cause, from the date of acceptance by the City for storm and sanitary sewers, water systems, street trees, street lighting systems and facilities appurtenant thereto;
      (3)   An amount determined by the Director of Engineering, Utilities, and Inspection and a period as determined by the city staff for temporary roads.
   (b)   Acceptance by the City shall not take place until this bond is posted.

   1107.99 PENALTY.
   Violation of any provision of this chapter shall be subject to the provisions of Section 1101.12 Enforcement, Violations, Penalties, Appeals.
