(a) There is hereby established the Department of Financial Services, to consolidate and perform all functions of the offices of Auditor, Controller, Tax Collector, and Treasurer, and any other county-wide fiscal functions directed by the Board.
(b) The Department of Financial Services shall be under the control and direction, and managed and administrated by, the Chief Financial Officer. (§ 3, Ord. 1450, eff. January 5, 2015)
(a) The Chief Financial Officer shall be appointed by a majority of the members of the Board at a salary to be determined by the Board.
(b) The Chief Financial Officer shall be responsible for the management and monitoring of the County's finances, including policy and planning, treasury and finance, tax and fee collections, accounting and financial reporting, and audits.
(c) The Chief Financial Officer shall, in collaboration with the County Administrative Officer, be responsible for the annual budget and financial planning of the County and its Departments.
(d) The Chief Financial Officer shall serve at the pleasure of the Board. He or she may be removed by a majority vote of the Board at any regular meeting of the Board, except that during the first three (3) months after any change in membership of the Board, the Chief Financial Officer may only be removed by a four-fifths (4/5) majority vote of the Board. The Chief Financial Officer shall have at least 90 days' notice of the Board's intention to remove him or her before such removal shall become final. The Board shall seek the advice of the Financial Oversight Committee prior to voting on whether to remove the Chief Financial Officer. (§ 3, Ord. 1450, eff. No person shall hereafter serve as the Chief Financial Officer unless the person meets at least one (1) of the following criteria:
(a) The person possesses a valid certificate issued by the California State Board of Accountancy under Chapter 1 (commencing with Section 5000) of Division 3 of the Business and Professions Code showing that person to be, and a permit authorizing that person to practice as, a certified public accountant; or
(b) The person possesses a baccalaureate degree from an accredited university, college or other four (4) year institution, with a major in accounting or its equivalent, as described in subdivision (a) of Section 5081.1 of the Business and Professions Code, and has served within the last five (5) years in a senior fiscal management position in a county, city, or other public agency, a private firm, or a nonprofit organization, dealing with similar fiscal responsibilities, for a continuous period of not less than three (3) years. After the appointment of the Chief Financial Officer, that person shall complete a valid continuing course of study as prescribed in this section, and shall, on or before June 30 of each two (2) year period, render to the State Controller a certification indicating that the Chief Financial Officer has successfully completed a continuing education program consisting of, at a minimum, forty (40) hours or an equivalent amount of continuing education units within the discipline of governmental accounting offered by a recognized state or national association, institute, or accredited college or university, or the California Debt and Investment Advisory Commission, that provides the requisite educational programs prescribed in this section. The willful or negligent failure of any Chief Financial Officer to comply with the requirements of this section shall be deemed a violation of this section. (§ 3, Ord. 1450, eff. January 5, 2015)
Article 21. Health and Human Services Agency
Pursuant to California Government Code Sections 24308 and 33200 and Welfare and Institutions Code Section 18986.86, the Yolo County Health and Human Services Agency is hereby established. The services and functions of the former Health Department, Department of Alcohol, Drug, and Mental Health Services, and the Department of Employment and Social Services are hereby integrated and consolidated into the Yolo County Health and Human Services Agency.
Any reference in this Code to the Health Department, Department of Alcohol, Drug, and Mental Health Services, Department of Employment and Social Services, and any departments or other existing organizations units referenced in substantially similar terms shall be understood to refer to the Health and Human Services Agency.

The Health and Human Services Agency is created for the delivery of services through an integrated and comprehensive County health and human services system. By operation of law, the Agency succeeds to and assumes all duties and responsibilities of the Departments referenced in Section 2-5.2101, above, for the administration of the various functions and services concerning public health, mental health, substance use disorders, employment, social services, and community services.

(a) Under the general direction of the County Administrative Officer and the Board of Supervisors, the Director of the Health and Human Services Agency shall plan, organize, and direct all activities of the agency in accordance with applicable federal, state, and local laws and regulations. The Director of the Health and Human Services Agency shall be appointed and serve at the will of the County Administrator.
(b) The responsibilities, authorities, and duties of the following positions are consolidated with the position of the Health and Human Services Agency Director:
(1) Director of Employment and Social Services
(2) Director of Social Services
(3) Health Director
(4) Welfare Director
(5) Public Guardian
(c) In addition, if the Director possesses all of the necessary qualifications and is appointed by the Board of Supervisors (or County Administrator, in the case of the Drug and Alcohol Administrator position), he or she may hold the following positions included within the organizational structure of Agency:
The consolidation of positions set forth above shall not apply to Community Corrections Partnership membership. The branch director with primary responsibility for each program area listed in Penal Code section 1230(b)(2)(G)-(J) shall be deemed the department or program head for purposes of Community Corrections Partnership membership.
(1) Mental Health Director, with qualifications subject to any regulations promulgated by the California Department of Health Care Services in accordance with Sections 5607, 5608, and 5751.1 of the Welfare and Institutions Code.
(2) County Health Officer, with qualifications subject to Health and Safety Code Section 101000 et seq.
(3) Drug and Alcohol Administrator, with qualifications set forth in Section 11800 of the Health and Safety Code.
(4) Director of Public Health Nursing, with qualifications set forth in Section 101110 of the Health and Safety Code.
If the Director is not qualified to hold or elects not to hold any or all of the foregoing positions, such position(s) shall be filled in the manner required by law and shall remain within the organizational structure of the agency. To the extent the Board of Supervisors has the power to appoint and remove an individual holding a position within the agency, the Director may recommend that the Board suspend or remove any such appointee.

(a) The Director of the Health and Human Services Agency shall have the discretion to organize and administer functions within the agency to ensure services and benefits are provided to the public through an integrated and comprehensive health and human services system. Such discretion shall be exercised in accordance with then existing federal, state, and local laws, as well as County policies established by ordinance or resolution concerning any reorganization or restructuring of the functions and operations of a county department or division of a county department.
Notwithstanding anything in this chapter, however, the Director of the Health and Human Services shall not impede the Health Officer from carrying out the duties, services, or functions required by state law or other provisions of this code. Additionally, the Director shall allow the final determination regarding issues of professional nursing practice shall be made by a person who is licensed as a registered nurse and certified as a public health nurse.
(b) The Director has authority to sign contracts binding on the County on matters within the purview of the agency, consistent with and subject to all County contracting policies. Such authority may be delegated in writing by the Director to other personnel that report directly to the Director.
(c) Functions and responsibilities described in federal, state, and local laws relating to the positions identified in Section 2-5.2103, above, shall be performed by the Director or, for positions identified in Section 2-5.2103(c), by the appointee to each such position (if other than the Director) under the general oversight of the Director. As necessary or appropriate, such functions and responsibilities may be delegated to appropriately qualified personnel within the agency. These functions and responsibilities include, but are not limited to:
(1) For mental health issues and the County alcohol and drug program, those matters described in Government Code Sections 24308 and 33200, Health and Safety Code Section 11800, and Welfare and Institutions Code Sections 5607, 5608, and 18966.86. The County alcohol and drug program shall be placed at the same administrative level and have responsibilities similar to other major health programs in the County.
(2) For public health issues within the statutory purview of the County Health Officer, those matters described in Government Code Sections 101025 through 101070. For all other public health issues, including public health and indigent health functions and operations, those matters described in Government Code Section 33201, and Health and Safety Code Section 101115.
(3) For social services, those matters described in Welfare and Institutions Code Section 10800 et seq.
(d) The Board of Supervisors, by ordinance or resolution, may create such subordinate positions in the agency established pursuant to this article, and set the salaries thereof, as may be necessary.
