107.01 ESTABLISHMENT.
   In view of the existing and increasing possibility of the occurrence of disasters of unprecedented size and destructiveness resulting from enemy attack, sabotage, or other hostile action, or from fire, flood, earthquakes or other natural causes, and in order to insure that preparations of the City will be adequate to deal with such disasters, and generally to provide for the common defense and to protect the public peace, health and safety, and to preserve the lives and property of the people of the City, the portions of West Virginia Code Article 15-5 which apply to municipal corporations within the State are now adopted by the City in order that an Emergency Services Agency under the provisions of such Article may be established for this City.

107.02 EMERGENCY SERVICES COUNCIL.
   There is created an Emergency Services Council which shall consist of five members who shall be appointed by the Mayor, with the advice and consent of Council. Council shall have power at any time to remove any member so appointed. At the expiration of the original terms, all members shall be appointed for terms of three years. A vacancy in membership shall be filled in the same manner as the original appointment is made and for the balance of the unexpired term. The members of the Emergency Services Council shall serve without compensation, and not more than three members of such Council shall be members of the same political party.
   The Emergency Services Council shall advise the Director of Emergency Services on all matters pertaining to emergency services.
   Neither the Emergency Services Council nor the Emergency Services Director shall have the power to declare or proclaim an emergency justifying the exercise by the organization hereby created of the emergency powers conferred upon it by this article or by the statutes of this State; such emergency shall be declared or proclaimed only in the manner provided by West Virginia Code 15-5-6, or by the Mayor in the manner otherwise authorized by law.

107.03 DIRECTOR OF EMERGENCY SERVICES; DUTIES.
   Council shall appoint a Director of Emergency Services who shall serve at the will and pleasure of Council. The Director shall coordinate the activities of all organizations for emergency services within the City and shall maintain liaison and cooperate with other emergency services agencies and organizations within the State and within the State government. The Director, subject to the direction and control of Council, shall be executive head of the local emergency services organization and shall be directly responsible to the Mayor and Council for the organization, administration and operation of the emergency services organization of the City.

107.04 POWERS AND DUTIES OF MAYOR AND DIRECTOR.
   The Mayor is authorized to cooperate with the State government, with other cities and counties and with private agencies in all matters pertaining to the emergency services of this City and of the State. The Mayor is further authorized and empowered:
   (a)   To prepare a comprehensive plan and program for the emergency services of the City, such plan and program to be integrated into and coordinated with the emergency services plans of the State government, and of other cities and counties within the State to the fullest extent.
   (b)   In accordance with such plan and program for the emergency services of the City, to procure supplies and equipment, to institute training programs and public information programs, and to take all other preparatory steps including partial or full mobilization of the emergency services organization in advance of actual disaster, to insure the furnishing of adequately trained and equipped forces of emergency services personnel in time of need.
   (c)   To make such studies and surveys of the industries, resources and facilities in the City as may be necessary to ascertain the capabilities of the City for emergency services and to plan for the most efficient emergency use thereof.
   (d)   On behalf of the City, to enter into mutual aid arrangements with other cities and counties within the State and also, with the approval of the Governor, with emergency services agencies or organizations of other states, for reciprocal emergency services aid and assistance in case of disaster too great to be dealt with unassisted.
   (e)   To delegate any administrative authority invested in him under this article to the Director of Emergency Services, to City officers and employees, or to other agents within the emergency services organization, and to provide for the subdelegation of any such authority.
   (f)   To cooperate with the Governor and the West Virginia Division of Emergency Services and with officials and agencies of other cities and counties within the State, in matters pertaining to the emergency services of the City and State, including the direction or control of:
      (1)   Blackouts and practice blackouts, air raid drills, mobilization of emergency services forces, and other tests and exercises;
      (2)   Warnings and signals for drills or attacks and the mechanical devices to be used in connection therewith;
      (3)   The effective screening or extinguishing of all lights and lighting devices and appliances;
      (4)   Shutting off water mains, gas mains, electric power connections and the suspension of all other utility services;
      (5)   The conduct of civilians and the movement and cessation of movement of pedestrians and vehicular traffic, during, prior and subsequent to drills or attack;
      (6)   Public meetings or gatherings; and
      (7)   The evacuation and reception of the civilian population.

107.05 MUTUAL AID ARRANGEMENTS.
   The Mayor may, in collaboration with other public and private agencies within this State, develop or cause to be developed mutual aid arrangements for reciprocal emergency services aid and assistance in case of disaster too great to be dealt with unassisted. Such arrangements shall be consistent with the State emergency services plan program, and in time of emergency, it shall be the duty of the City organization for emergency services to render assistance in accordance with mutual aid agreements.
   The Mayor, subject to the approval of the Governor, may enter into mutual aid arrangements with emergency services agencies or organizations in other states for reciprocal emergency services aid and assistance in case of disaster too great to be dealt with unassisted.
